The Justice Reform had the principle of cleaning the system from individuals who were corrupt or had not done their duty well and everything was according to some standards in relation to the income they had generated, or the decisions they had made.

The Reform in Justice also gave birth to the SPAK , an Anti-corruption Structure that, in fact, in so many years that it has been in operation, we have not seen it to be much more effective than the former Court of Serious Crimes, despite some cases that are claimed to be spectacular, but their fruits have not yet been seen.

The last standard used by SPAK and its prosecutors for Ilir Beqaj, the former minister of Edi Rama, is a scandal in itself, which shows that the Reform in Justice did not give birth to healthy children, without corruption, who are untainted and they have not put their hands in the mire of corruption.

At first, it was requested that Ilir Beqaj should not be charged at all, and this was a scandal , which CNA reported at that time.

Secondly, it was the judge Erion Bani, who asked to deepen the investigation for Ilir Beqaj and now again the prosecutor Edvin Kondili does not give a measure of arrest with prison, since Ilir Beqaj can spoil the evidence, because he was on duty in an important institution , appointed after an accusation was filed by SPAK not only for the issue of sterilization, but also for the "check up" that is under investigation. 

SPAK, for a man who was in office, a state functionary and who had been strongly publicly defended by the top politicians of the ruling party, did not go to the measure of prison arrest, but used a different standard, initially not taking him at all. defendant and then taking his passport and investigating him at large.

What prosecutor Edvin Kondili has done is the fact that Ilir Beqaj will now be freed until the investigation and trial are over , 3-5 years at all levels, and it seems clear that there will not be a strong measure of security against the former - the minister.

This is where SPAK's standard has fallen and this is where the leap happened. The case of Jamarbër Malltez, was demonstratively arrested in public, a professor, an intellectual, with his hands in his pockets, who had benefited from his property, had developed it, on the other hand had not benefited from any public money, had not even given concessions, neither did Jamarbër Malltezi, but he was kept in prison.

Today the court put him under "house arrest", which showed that the first measure, the first actions were quite severe, excessive, that Maliqi makes the law or what?

The other case, for those who cry, is that of former Deputy Prime Minister Arben Ahmetaj. Why should Ilir Beqaj be free and Arben Ahmetaj should be arrested?

Ilir Beqaj was in office, Arben Ahmetaj was out of office. Should they both be arrested or should they both be pursued at large?

The standard that SPAK will use cannot be one of the mother and one of the stepmother, as people say.

What is required is a uniform standard. Is a standard set with Arben Ahmetaj? Was he the right one? Why did he change with Ilir Beqaj? Either you were wrong with Ilir Beqaj, or you were wrong with Arben Ahmetaj, or you were wrong with Abi Malltez?

Either Ilir Beqaj is protected by Rilindja, by the government, by its connections with Edvin Kondil, with SPAK prosecutors, and his colleague has been declared an "enemy", or he has a disability, or he has corruption, or what can be the option that should justice say?

Because we have 3 cases with 3 different standards, and if SPAK will thus overcome delicate issues related to high officials of the Albanian state, or individuals for whom it investigates, the confidence of the Justice Reform and the confidence of SPAK will continue to decline.

It will continue to fall in the case of former Prime Minister Sali Berisha, whose immunity had to be requested from the Assembly and was not done as it happened in the case of Saimir Tahir.

Therefore, the above cases, Berisha's cases and others raise the alarm that SPAK prosecutors act with different standards for the same cases.

We have SPAK that sends you behind bars and declares you wanted, we also have SPAK that for the same issues leaves you at home, lets you go free even though you risk destroying the evidence.

Could these be the standards of the new justice and SPAK that Albanians hope for so much or are they deformed standards of the new justice?/ CNA
