The madness of a defendant's lawyer

Plarent Ndreca has made an epochal discovery in procedural law today. According to him, the court should not schedule a hearing without first obtaining the consent of the lawyers!

Fantastic! Someone should urgently send this theory to law schools. Maybe the Criminal Procedure Code should be rewritten too.

So, according to this logic, the judge no longer sets the date of the hearing. He opens a WhatsApp group: “Please, who is free next week?” If one has another trial, another is on vacation, a third has a conference, and a fourth has a working lunch, the trial is postponed. Until everyone agrees. Maybe in 2030.

The irony is that we hear this claim after the GJKKO fined him for his absence, arguing that it caused the process to drag on. Instead of saying "yes, I was absent", he comes up with the thesis that the problem was not the absence, but the fact that the court did not grant him permission for the date.

Meanwhile, the trial against Erion Veliaj is the best example of where this philosophy leads. Nearly a year has passed and the trial has still not started normally, precisely because of the absences and requests for postponements from the defense. Now imagine if the court also waited for the formal approval of each lawyer for each session. We would no longer be talking about a criminal trial, but about a series without a first episode.

In fact, there is no article in the Criminal Procedure Code that states that the court must negotiate hearing dates with the parties. Otherwise, each lawyer would have a veto right over the court calendar.

This is the latest legal innovation of a defendant who also acts as a lawyer. We should all listen and agree to the principle of the "right to never have a hearing". Or to have it when this defendant "lawyer" deems it appropriate./ CNA
