Mr. Manja, please translate paragraph 55 of the decision for Beler into
Ulsi Manja, Minister of Justice

The Minister of Justice, Ulsi Manja, responded today to repeated accusations by the elected mayor of Himara, Fredi Beleri. He explained the reason why Beler was not given permission to take the oath.

Among other things, Minister Manja said:

"Our attitude is constant. The Beleri case belongs to justice and as far as the oath issue is concerned, I would beg you to familiarize yourself with the decision of the Supreme Court, which has resolved the deadlock between Durrës and GJKKO regarding the consideration of Beleri's request to be allowed to he swears.

In the decision of the Supreme Court, in point 55, make no mistake, the correct reasoning states that it has to do with the legal position held by the Ministry of Justice and the Directorate of Prisons".

CNA.al took Minister Manja's plea seriously. From the website of the Supreme Court, we found and extracted point 55 and, (to be on the inside), also point 56 of the decision of the Supreme Court to which we believe the Minister was referring.

CNA.al invites its readers to stick to the challenge given to us by the minister and to read these two points from the decision:

"55. Under the same conditions, the College considers - in support of the conclusion, according to which, during the trial of the criminal case, it is the court that proceeds - that materially disposes of the acts - competent to pronounce on any request of the defendant, including subsidiary requirements, related to the trial of the main and incidental proceedings (which refer to the revocation, replacement and extinguishment of the measure of personal security determined to ensure the main proceedings) - as in the present case the request for a special permit - access to the heads of the detention institution - in the verification (evaluation) of the conditions of application of this permit - in the conditions of non-existence.

56. As long as the criminal proceedings - the trial of the case - the charge - against the defendant in custody is pending before the Court of trial of the case on the merits, which disposes on a case-by-case basis in addition to the trial of the main proceedings, also related to the measure of personal insurance (of arrest in prison) assigned to him in the framework of the incidental proceeding "implemented" during the preliminary investigation phase - in function of ensuring and guaranteeing the main proceeding - verifying the continuity (even in this phase of the proceeding) and the stability of the needs of ensuring this procedure - also judging requests for "special permits" (during this stage) - evaluating - verifying - the conditions of their granting, as long as they directly involve the "integrity" of these needs (of ensuring ) - cannot be realized beyond and bypassing - the filter of jurisdictional control - the substantial consensus (will) of the body (of criminal proceedings) - of the court (that proceeds) of the trial of the case on the merits."

These are copy-paste, only 2 of the paragraphs of the decision. (Whoever is curious can read many more.)

At the end of this exercise, CNA poses these questions publicly not only to Minister Manja:

-From which language are these paragraphs translated?

-Can they be translated into Greek, preserving their "meaning"?

- In which language did Minister Manja read them that seemed clear to him and if he needed a translation, can he make public the name of the translator?

- Have the authors of the decision recently been checked for the stability of their mental health? If not, is it planned to set the KED in motion in the near future to organize the mental health check of these persons?

The Beleri issue is an issue with an extreme load for the international interests of the Republic of Cyprus and for Albania-Greece relations.

These paragraphs in the born "battle" will most likely have to be translated into English or other languages.

As far as the Minister is concerned, he should be congratulated both in the case when he managed to understand the paragraphs of the decision in words, and in the case when, like the old Dibran, he mocked the author of the "clear" text.

But if the author of the text is certainly irresponsible (in some sense) for the importance of the subject with which he had to deal, we hope that at least the Minister will understand what our concern is./ CNA
