Ilir Meta cannot be saved by “his judges” in the Constitutional Court/ Revealed the plan for the dismissal of the President of the Republic

It seems that the Constitutional Court has left for September the review of the constitutionality of the dismissal of President Ilir Meta from the parliament, after filling the vacancies. We are currently in the second week of July, and all likelihood show that the ?Meta? case will wait for the autumn.

According to the Law on the Constitutional Court, the notification for the first hearing must be made one month in advance. But currently this cannot happen, as August is a holiday for the courts. So the names to which Meta has relied on to be elected a member of the Constitutional Court, or who are described as ?his people? in this court, will not be able to influence the decision on his case, as the court is expected to be supplemented with new names.

The names are the judge Marsida Xhaferllari, who has the strong supporting of Ilir Meta, and the latter insisted on her appointment. Sonila Betja, who is known for the support she has had from the president, and the chairwomen Vitore Tusha, whom Meta previously proposed as head of the Supreme State Audit.

After filling the vacancies with the Constitutional Court with new names, the influence of Meta?s ?supporters? will be minimal, and in these circumstances he can be dismissed from the post of head of state. 9 people have applied for 3 vacancies in the Constitutional Court. They are Albert Demirneli and Alket Jaupi, who are running for the vacancy created by the departure of Fatmir Hoxha. Meanwhile, the candidates Dhimitrula Spiro, Ervin Karamuço, Helena Papa, Sander Beci, Vatë Staka and Zhaklina Peto are running for the vacancies created by the departure of Judges Fatmir Hoxha and Vitore Tusha.

The candidate Saimir Visha, hasn?t determined for which vacancy he is running. The battle for the removal of Ilir Meta from the post of President of the Republic, was moved to the Constitutional Court after June 14, when the Parliament submitted to the court the decision for his dismissal from the high post of President of the Republic, which was previously approved in plenary session with 104 votes.

Along with the request for dismissal, has been filed a complete file, which includes the description of the arguments of the constitutional violations, committed by the head of state as well as the evidence proving these violations.

In case the Constitutional Court finds that the decision of the Parliament is supported in evidence and facts, then will dismiss the President. Otherwise, she will abrogate the decision of the Parliament./CNA.al
