After a series of court sessions and delays, finally in 2023 the investigations into the incinerator of Elbasan, Fier and Tirana were completed and the Special Prosecutor's Office demanded prison terms for the people of the affair of the century, as well as its "bosses", Mirel Mërtir, Klodian Zoton and Stela Gugallja.

Regarding the Elbasan incinerator affair, the Prosecutor's Office requested:

- 10 years in prison for the former Minister of the Environment, Lefter Koka, who is accused of corruption by benefiting about 3.6 million euros from the two concession companies.

- 10 years in prison was also requested for Mirel Mërtir, described by SPAK as the mastermind of the incinerators, and for Klodian Zoto.

For Stela Gugallja, a sentence of 7 years in prison was requested for the criminal offenses "Active corruption of high state officials or local elected officials", "Cleaning the proceeds of a criminal offense or criminal activity" and can be sentenced to 4 years and 8 months. jail.

For the former secretary of the Ministry of Environment, Alqi Blako, 4 years in prison was requested for "abuse of duty, carried out in cooperation" and he can be sentenced to 2 years and 8 months in prison.

SPAK has also requested the confiscation of the two main companies that benefited from the concession worth 24 million euros, "Integrated Technology sh.pk" and "Alb Tech", as well as the 4 companies that paid them.

Among other assets, the confiscation of 8 apartments and three real estates of Lefter Koka was requested, as well as 88% of the shares of the former Minister of the Environment in his winery, "Gjergj Kastrioti Skënderbeu", located in Durrës. .

Penalties:

Lefter Koka, SPAK requires 10 years, benefits 6.8 with shortened trial.

Alqi Blako , SPAK requires 4 years, benefits 2 years 8 months with shortened trial.

Mirel Mërtiri, SPAK demands 10 years in prison, gets 6 years and 8 months with a shortened trial.

Stela Gugallja, SPAK demands 7 years in prison, gets 4 years and 8 months with shortened trial.

Klodjan Zoto, SPAK demands 10 years in prison, gets 6 years and 8 months with shortened trial.

Pëllumb Abeshi , SPAK demands 4 years in prison, 2 years and 8 months with a shortened trial.

Jonida Zeqo, SPAK requests 4 years in prison, 2 years and 8 months with a shortened trial.

Serafin Papa, SPAK demands 4 years in prison, gets 2 years and 8 months with shortened trial.

Bardhyl Çabiri, SPAK demands 4 years in prison, gets 2 years and 8 months with shortened trial.

For the Fier incinerator, the former Minister of the Environment,  Lefter Koka , was sentenced to 10 years in prison by GJKKO for the Fier incinerator affair, but with a shortened trial he will serve 6.8 years in prison.

The former deputy of the SP,  Alqi Blako , was sentenced to 4 years in prison, but with a shortened trial he will serve 2.8 years in prison.

Klodian Zoto  was sentenced to 11 years in prison, but with a shortened trial he will be sentenced to 8 years in prison.

Erjon Murataj , member of the concession granting commission, is sentenced to 3 years in prison, he will eventually serve 2 years in prison.

Azem Shatëri, member of the concession granting commission, 3 years in prison, with a shortened trial, 2 years in prison.

Loran Dusha , administrator of the Fier incinerator, has been sentenced to 7 years in prison, he will eventually serve 4 years and 8 months in prison.

Arbër Denizi , administrator of PIVOT-04, is sentenced to 7 years in prison, with a shortened trial of 4 years and 8 months in prison. 

Florian Muçaj,  member of the concession granting commission, 3 years in prison, with a shortened trial of 2 years in prison! He is released from prison, his sentence is over

4 other people have had their sentence converted to probation: 

- Regan Merdani, Administrator of "Froggy" sh.pk, 3 years in prison (suspended sentence) probationary service

- Gentian Zifla, Administrator of "Itneg" sh.pk 3 years in prison (suspended sentence) probationary service

-Sabina Cenameri, member of the concession granting commission, 3 years in prison (suspension of sentence, has a minor child) probationary service

-Pellumb Abeshi, the former official of the Ministry of Environment, was sentenced to 3 years and 6 months in prison, with a shortened trial of 2 years and 4 months in prison, eventually with probation. 

TIRANA INCINERATOR

SPAK also conducted investigations into the incinerator affair, where the theft that was done to the Albanians and the state was the biggest.

After the investigations, 15 arrest warrants were issued for the Tirana incinerator, where important officials and directors of the Tirana Municipality were put in handcuffs.

Erjon Murataj, Bledar Karoli, Taulant Tusha, Namik Simixhiu and Jetmir Llapaj ended up in handcuffs.

Accusations for the affair in Tirana also burden the former Minister of the Environment Lefter Koka and his former secretary Alqi Blako, who are currently in prison.

Also, there are arrest warrants for the heads of the incinerators, Klodian Zoto and Mirel Mërtiri, who are wanted internationally for the affairs in the two incinerators of Elbasan and Fier.

Alba Thoma, Valbona Ballgjini, Sidita Kopliku, Pëllumb Abeshi, Etleva Kondi and Sidita Tola were left under house arrest.

The arrest warrants were signed by prosecutor Dritan Prençi, who followed the investigations into this affair.

Journalist Elvi Fundo had also warned about the arrests in the case of Tirana.

But the file, as it was said by the journalist Elvi Fundo, has several factions and will not be closed only with a few directors in handcuffs.

New arrests are expected as the media involved in the incinerator scandal are also being investigated.

SPAK has provided details regarding the charges against the persons involved.

SPAK has revealed step by step the scheme of the corrupt affair worth 110 million euros, thus confirming all the denunciations and hundreds of articles reported earlier by CNA about this corrupt affair.

First violation: According to SPAK, the decision for the procedure for the incinerator is made by the members of the concession granting commission. Members Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Temali, Etleva Kondi, Taulant Tusha, Namik Simixhiu, in cooperation with Lefter Koka in the capacity of Minister of Environment, Alqi Blako, in the capacity of Secretary General of the Ministry of Environment, Alba Thoma , Director of the Legal Directorate of the Ministry of Environment and Bledar Karolin have violated 2 laws: "On concessions and public private partnership", as amended, and VKM no. 575, dated 10.07.2013, "On the approval of the rules for evaluation and awarding by concession/public private partnership", amended.

They have proposed granting the bonus, without drawing up a summary report, and when the proposal for granting the bonus was made, the commission granting the concession had not yet clarified the costs of the project. The above officials of the Ministry of Environment were the responsible persons who prepared and then sent the draft decision to the Council of Ministers, for granting the bonus of 8% of the total points of the competition of the proposing company.

The second violation: In relation to the procedure for granting the concession with the object: "Construction of landfill, incinerator and rehabilitation of the existing storage site in Tirana and the production of electricity", it results that the proposing company "Integrated Energy BV", whose composition is the company "Integrated Technology Services" sh.pk, owned by the citizen Klodian Zoto, has been aware of the competitive circumstances since before the procedure for granting the concession was announced.

Third violation: The Concession Standard Documents are not drawn up and approved by the members of the commission, at the time these documents are uploaded to the Electronic Procurement System, as it turns out that the commission did not hold a meeting or minutes for the drafting of the Documents Concession Standards.

According to SPAK, the documents were drawn up by the employees of Klodian Zotos, owner of the company "Integrated Technology Services" sh.pk, participating in this concession procedure as a shareholder of the Dutch company "Integrated Energy BV", who then sent them to the employees of Ministry of Environment, citizens Alba Thoma and Bledar Karoli.

At this time, these two citizens have served as a bridge between the Contracting Authority, the Ministry of Environment and the society of the citizen Klodian Zoto. On the part of the holder of the Contracting Authority, the former Minister of the Environment, Lefter Koka, the continuation of the concession granting procedure was approved, without accompanying documentation of the drafting of the Standard Concession Documents by the Commission.

Fourth violation: Fictitious data placed in the feasibility study result from the administered acts, which have fictitiously increased the fee for waste disposal by Local Government Units, 29 euros/ton.

In the feasibility study prepared by the Commission for granting the concession, all the real incomes that the concessionaire company would benefit from were not taken into consideration. These revenues, which are not included, negatively affect the state budget, since if they were calculated, then the value of the fee that the Local Government Units would have to pay would be lower. The commission for awarding the concession did not include the income that the concessionaire company would receive from third parties for the deposit of inert waste, causing damage to the state budget. If the income that the concessionaire company would benefit from third parties had been calculated, as an income item in the feasibility study, then the part of the coverage that would be carried out by the state would have been reduced.

Fifth violation: Alqi Blako, in the capacity of General Secretary, indirectly benefited irregularly from Klodian Zoto and Mirel Mërtiri, the monetary value of 119,755 euros, with the aim of favoring the concessionaire company during the concession granting procedure. Integrated Energy BV", in which Klodian Zoto's company, "Integrated Technology Services" sh.pk, was also a shareholder

Citizen Alqi Blako secured this irregular benefit from citizen Klodian Zoto through payment for the equipment "Machinery for filling, closing, sealing or labeling bottles, machinery for carbonated drinks", worth 119,755 euros. This equipment has served for the commercial activity of his father's company, Edmond Blako, the economic operator "Edmond Blako", a natural person, which had as its field of activity the production and trade of beer in the city of Erseka. This equipment turns out to have been purchased after the request made by the citizen Alqi Blako himself, by order of the citizen Klodian Zoto, made through the company of his wife, Ilza Zoto, "Artemis Farm" sh.pk

Also, it turns out that the citizen Alqi Blako, in the capacity of the General Secretary of the Ministry of Environment, has requested/proposed to the citizen Klodian Zoto the granting of an irregular benefit to Vladimir Bezhan, while the latter was an external adviser to the Minister of Environment, by fictitiously employing him in the company of the citizen Klodian Zoto, "Integrated Technology Services" sh.pk, this with the aim of favoring the concessionaire company "Integrated Energy BV", during the procedure of granting the concession, in the composition of which he was shareholder also the company of citizen Klodian Zoto, "Integrated Technology Services" sh.pk Citizen Vladimir Bezhani has received irregular benefits thanks to the salary given by the company of citizen Klodian Zoto, in the amount of 7,520,000 (seven million five hundred and twenty thousand) Lek.

Sixth violation: The investigation resulted in evidence that citizens Klodian Zoto and Mirel Mërtiri have used other persons and companies to hide their traces as the real owners of the concession company "Integrated Energy BV SPV" sh.pk, who are also the beneficiaries. real of this concession contract.

It has been proven that the citizens Klodian Zoto and Mirel Mërtiri are the people who guided and made the decisions regarding the concession company "Integrated Energy BV SPV" sh.pk and the parent company in the Netherlands, with the previous name "Integrated Energy BV". currently "Geogenix BV", which corresponds to the moment of establishment of these companies and continues.

From the acts administered up to this stage of the investigation, it results that the citizen Klodian Zoto, in cooperation with the citizen Mirel Mërtiri, have benefited thanks to the forged tax invoices, the monetary value of 409,428,000 (four hundred nine million four hundred twenty eight thousand) lek, where the citizen Klodian Zoto appeared and declared falsified invoices for works performed through his other company, "Integrated Energy Services" sh.pk, as a subcontractor of the concessionaire company "Integrated Energy BV SPV" sh.pk At the time of issuance of these forged invoices, it is proven that the "de facto" shareholders were the citizens Klodian Zoto and Mirel Mërtiri.

A large part of these monetary values ??secured thanks to the fraud, were withdrawn in "cash" and were transferred in different ways abroad by the citizens Klodian Zoto and Mirel Mërtiri, who are also the product of the criminal offense.

During the investigation, the fact that citizens Mirel Mërtiri and Klodian Zoto, as the "de facto" shareholders of the concession company "Integrated Energy BV SPV" sh.pk, was identified, are the people who prepared falsified estimates, inflating the indicators in the construction costs, included in the feasibility study presented by them, for winning the concession contract no. 6597, dated 31.08.2017 with the object "Construction of landfill, incinerator and rehabilitation of existing storage sites, Tirana".

Seventh violation: Employees of the National Business Center, of the Register of Beneficial Owners, citizens Jetmir Llapaj and Silena Tola, have acted in violation of Law No. 112/2020 "On the Register of Beneficial Owners", as well as VKM No. 1008, dated 24.12.2020, "On determining the manner and procedures of registration and publication of data for the beneficial owners, as well as notification by the competent state authorities and by the obliged entities".

It turns out that on 25.06.2021 changes were made in the CKB register, regarding the shareholders of the Dutch company "GeoGenix" (previously with the trade name "Integrated Energy BV"), which turns out to be the owner of 100% of the shares of the concessionaire company "Integrated Energy BV SPV" sh.pk The shareholders of the Dutch company "Geogenix BV", according to this completed registration, are declared to be the citizens Giuseppe Ciaffaglione, with Italian citizenship, beneficiary of 30% of the shares of the company "GeoGenix ", Salvatore Russelli, with Italian citizenship, beneficiary of 25% of the shares of the company "GeoGenix", Alberto Presezzi, beneficiary of 43% of the shares of the company "GeoGenix".

In relation to the registration of the ultimate beneficial owners of the company "Integrated Energy BV SPV", it turns out that the accompanying justifying documentation was not submitted and administered to prove the change of the relevant shareholders for the time period in question, according to the definitions of the legal and by-laws mentioned above above./ CNA
