EXCLUSIVE PHOTOS/ EU in the committee preparing the draft of the new Criminal

The debate over the new draft Penal Code of Albania has now gone beyond the tables of experts. It has reached the media, journalists, institutions, and continues to be what appears to be blackmail, pressure, political games, lobbying, vested interests, and intrigue, all of which came together in the new draft Penal Code, immediately after the Supreme Court's decision to imprison the mayor of Tirana, Erion Veliaj.

Is it a coincidence? This doesn't happen in Albanian politics.

Someone may say that it is a bad draft-Code, but no one can say that Albania does not need a new Penal Code. Someone else says that the EU was not aware.
In fact, we are bringing these two photos, where Agnes Bernhard, a former representative of the EU-EURALIUS mission for assistance in justice, is also present, together with Idlir Pecin, also part of this mission.

So, these photos from September 2023 show us that at that time the EU was aware and with its longest-term representatives in the country, the people who have also contributed to the justice reform. The lie that the EU was not aware, and neither were the internationals, here brings up some other questions.

How is it possible that an EU official and representative of EURALIUS goes and participates in the commission? It seems that the Code is discussed in a planned manner, gives quite substantial assessments, makes a very valuable contribution, but the EU officials in Tirana seem to then turn into laughingstocks. These photos make it even more so.

CNA reported that they are being ridiculous about a simple fact; one time they say one thing, and another time they say another, and now the photos show us that EU representatives have been part of and people with very important contributions, not only to the Code, but also to justice reform.

Let's go further. Beyond the debate and attacks on the draft Code, it is a working document and that's simple. Who is worried about EU officials? Who made Olsian Çela jump out of trouble and lie publicly.

For these first ones, the EU, it's quite simple. They want projects, to receive funds worth tens of millions of euros and then to put them back into the pockets of their administration and officials, to tell us, as we have often repeated, that rakia is made from grapes.

Of course, the new Criminal Code must receive the "blessing" of the EU.

Por ky nuk është Kod, është thjesht një draft-Kod, një dokument pune që do të sqarohet derisa të marrë formën më të mirë sipas kërkesës së bërë nga BE-ja. Janë vetë zyrtarët e BE-së që i kanë kërkuar Shqipërisë që të miratojë një Kod të ri Penal deri në fundin e vitit 2026 dhe të fusin në diskutim një Kod Civil po brenda këtij viti. Tani ekspertët janë në tavolinë, përfaqësuesin BE-ja e ka. Pse reagojnë dhe një herë thonë se kanë qenë, një herë thonë se nuk kanë qenë? Thjesht për të marrë ca fonde, siçe përmendëm më lart.

Në lidhje me Prokurorin e Përgjithshëm, është i qartë se ai e ka pasur përfaqësuesin e tij. Doli dhe u distancua, kur duhet të bënte krejt të kundërtën. Duhet të mblidhte ekspertët, të bënte komentet dhe në rast se i pranoheshin, do ishte shumë mirë në rast se i pranoheshin. Mund të vazhdonte kontestimet e tij në grupet parlamentare, në grupet e ekspertëve dhe të interesit, ku do të diskutohej. Por edhe me këtë diçka cedoi.

I vetmi person që mbajti një qëndrim serioz ishte Altin Dumani, kreu i SPAK-ut, i cili tha se nuk kanë qenë pjesë e hartimit. Dhe e vërteta është se SPAK nuk ka qenë.

“Do e shohim, do bëjmë komentet tona, do t’i çojmë t’i vlerësojmë, për të pasur një Kod sa më të mirë”,-tha Dumani.

Në fund, lind një pyetje. Zyrtarja e BE-së është në tryezë, ndërkohë që përfaqësuesi i BE-së në Tiranë mbajti dy qëndrime kontradiktore. Prokurori i Përgjithshëm doli dhe u distancua. Mediat, në bashkëpunim të ngushtë më Erion Veliajn dhe që kanë segmente lidhjeje me Olsian Çelën, po vazhdojnë e po luftojnë kundër draft-Kodit.

Mos vallë përtej fotove, që na tregojnë shumë, ka ndonjë skenar tjetër? Kur dikush pas hekurave po lufton Kodin e ri Penal për të luftuar Edi Ramën. Dhe duke qenë se nuk mundet të godasë kryeministrin, ka gjetur si shënjestër Ulsi Manjën.

Janë të njëjtët njerëz që luftuan kundër SPAK-ut, që çfarë nuk shpifën për prokurorët e këtij institucioni, që çfarë nuk thanë me gënjeshtra për Erion Veliajn e që janë angazhuar njëkohësisht kundër ‘luftës’ ndaj draft-Kodit të ri Penal. Përdorën si armë zyrtarët e BE-së. Ja ku i kanë në foto. E morën dhe e keqpërdorën Prokurorin e Përgjithshëm. Doli me fakte e dokumente se është zbuluar, pasi ka qenë në dijeni. Merren me copëza dhe jo me thelbin.

A ka ky draft-Kod i ri problematika? Po, patjetër. A ka shqetësime? Pa asnjë diskutim. A po kërkohet të hiqet shpërdorimi i detyrës, shkelja e barazisë së tenderave, problematika të tjera, ku dikush nga debati mund të ishte pro e dikush kundër? Pa asnjë diskutim.

But the answer to the question 'Why is it being attacked?' is quite simple.

Because a working document is being attacked, which has not yet been put on the other tables of experts, of justice representatives, to give their opinions regarding what needs to be softened or what articles should have more severe penalties, how it adapts to the Albanian reality, how it should be done to be acceptable to the EU. But, this is done step by step and not now. 

Now we will only hear lies.

Like the fact that we had no EU representatives, like the fact that there were no other experts, but only these people at the table, when in fact the truth is that there were dozens of experts called to the table, they gave their opinions and came up with a product, which will now be taken and processed to come out in its final version. And it is not a Penal Code, nor a draft Code as mentioned, but a draft, a working document. There will be endless changes, but along the way we will hear lies, attacks, accusations, anathemas, which clearly seem to come from the same media line from which Erion Veliaj also passes./CNA
