Appointments to SPAK and GJKKO/ Constitutional Court Decides

Magistrates who have successfully passed the vetting process at both levels, including the KPK and KPA, will find out in the Constitutional Court's decision in March whether they will be able to be part of SPAK as prosecutors and the Special Court as judges. Previously, the personnel evaluation commission excluded them for ineligibility even though they were certified by vetting.

According to what "weblajme.com" reports, in March of this year the Constitutional Court is expected to decide whether point 5 of article 6 of the law on the organization and functioning of institutions that fight organized crime and corruption is constitutional or not.

Procedure for verifying security conditions before appointment to duty

5. The Special Courts against Corruption and Organized Crime, the Special Prosecution Office and the National Bureau of Investigation shall establish the Special Committee for the Verification of the Assets and Character of Candidates to verify the security conditions prior to assignment or appointment, consisting of:

a) two prosecutors of the Special Prosecution Office, selected by lot. The process of selection by lot is monitored by the Ombudsman;

b) a judge of the special courts against corruption and organized crime, selected by lot. The selection process by lot is monitored by the Ombudsman;

c) an employee of the financial investigation section of the Special Prosecution Office, appointed by the Head of the Special Prosecution Office;

ç) an investigator of the National Bureau of Investigation, appointed by the Director of the National Bureau of Investigation.

And, if this article is repealed, then magistrates would have the right to be appointed to SPAK and GJKKO, while if it is left in force, then they will be considered excluded even though they have received the consent of the KLP or KLGJ.   

This session will be held on March 27, 2025 at 10:00 AM based on documents, while the government, the Council of Ministers, and the Parliament in the role of proposer and legislator have been invited as interested parties. /CNA
