The spokesperson for corruption in the Democratic Party, Genta Vangjeli, in a statement to the media, announced that in Lezha, the Chairman of the District Council, Agron Ivani, has acted in violation of the law by approving a construction permit on the island of Shëngjin.
Vangjeli, in her statement, listed all the violations in bullet points, also publishing documents, while emphasizing that the Municipality of Lezha, the Inspectorate of Territorial Protection, the police and the Prosecutor's Office have also cooperated in these illegal actions of the Chairman of the District Council.

The full statement of the spokesperson for corruption in the Democratic Party, Genta Vangjeli:
The Chairman of the Lezhë District Council, Agron Ivani, by his decision no. 8, dated May 19, 2023, approved a construction permit (extension of deadline and change of construction entity), according to the decision of the Lezhë District Regional Construction Committee no. 24, dated March 31, 2009, with the following object:
"Residential and service building 1, 8, 9, 10 floors with one underground parking floor on the island of Shëngjin, Lezha".
The term of this building permit is until May 31, 2028.


In addition to the fact that the investor according to this permit is an entity that has declared a capital of 10 thousand lek and has only 3 years of active commercial activity, without publishing any balance sheet in the Central Register, through this permit issued by the District Council, signed by Agron Ivani and planning specialist Ferdinand Ndoj, an act was acted in violation of articles 27, 40, 59 of Law No. 107/2014 "On Planning and Territorial Development", as amended.
The construction permit, dated 13. 05. 2023 of the Lezha District Council for 'Deadline extension and change of construction entity' is illegal for several reasons:
1- The transitional provisions of Law No. 107/2014 'On territorial planning and development, as amended' (the legislation regulating the sector), in point 1, stipulate that "For construction permits, for which the deadline for the implementation of the works, specified in the relevant permit form, has expired, before the entry into force of Law No. 107/2014 "On territorial planning and development", as amended, the deadline may be extended by the responsible authority, at the request of the developer, provided that no more than 10 years have passed from the date of approval of the construction permit and the subject has previously paid the penalties provided for in Article 52 of Law No. 107/2014 "On territorial planning and development", as amended.
The original permit is dated 31. 03. 2009, so more than 10 years old.
2- Article 40 of Law No. 107/2014 'On territorial planning and development, as amended'
(the legislation regulating the sector), in point 6, stipulates that "For works started more than ten years ago and still unfinished, according to the approved project, the authority responsible for approving the construction permit determines the method of forced construction or decides on the demolition or confiscation of the construction".
Article 59 of Law No. 107/2014 'On territorial planning and development, as amended'
(legislation regulating the sector), in point 4, stipulates that "The extension of the permit term and the change of the implementing entity for construction permits approved before the entry into force of this law are carried out according to the provisions of this law."
And Article 27 'Responsible Authorities', establishes that "The authorities responsible for the development of the territory are: 1. The National Council of the Territory. 2. The mayor." and in no case the District Council.
So, the District Council has performed functions that belong to other development authorities.
These illegal actions of the President of the Lezha District Council certainly do not go unnoticed by other law enforcement institutions, but part of this illegal scheme and money distribution are certainly also the Municipality of Lezha, the Inspectorate of Territorial Protection, the police and the prosecution.
With their blessing, it is allowed to break the law with both feet, by building multi-story buildings in Shengjin, and occupying every part of the Shengjin coast and beyond.
But it doesn't end there, as construction is completed with completely illegal documents, the buildings are legalized and procedures for the sale of the apartments begin.
This is how Rama's government officials and pseudo businessmen who launder money get rich, and of course a good portion of it is put into circulation to buy votes every time there are elections.
The Democratic Party demands the immediate suspension of this construction permit and others similar to it, reminding the institutions and specific violators that criminal charges are ready... /CNA
