Socialist Party MPs have drafted a 27-page report, through which they have listed the reasons that led the majority to reject the request filed by opposition representatives for the dismissal of Parliament Speaker Niko Peleshi.

The report argues that the Speaker of the Assembly has meticulously implemented all of his constitutional and legal responsibilities in leading the plenary session and has shown a spirit of cooperation and tolerance in leading parliamentary activity as a whole.

Conclusions of the report:

Based on the full legal and factual analysis, we assess that the alleged violations in the request submitted by 36 deputies for the dismissal of the Speaker of the Assembly, despite the fact that in the formal and procedural aspect it meets the conditions to be reviewed by the Council for Legislation according to the legal provision of Article 114, points 1 and 4, does not meet the substantial condition for the constitutional reasons required, in order to consider the actions of the Speaker of the Assembly as violations.

The filed request does not meet the substantial condition, as not only is there no constitutional violation as one of the requirements of Article 114/1, but no violation of the Rules of Procedure of the Assembly is proven as alleged in the request.

Based on the assessment of facts and evidence such as the minutes and visual and audio footage of the session of September 16 and 18, 2025, it results that:

The Speaker of the Assembly has meticulously implemented all his constitutional and legal responsibilities in conducting the plenary session. The Speaker of the Assembly has shown a spirit of cooperation and tolerance in conducting parliamentary activity as a whole, respecting first and foremost his opposition MP colleagues and standing above the parties while conducting the session.

The Speaker of the Assembly, while conducting plenary sessions, has shown prudence by adhering to ethics and communication even when provocations or lack of ethics, as well as labeling by some opposition MPs, have been unworthy of the MP's mission in representing the citizens of the country.

The Speaker of the Assembly has respected all constitutional provisions and the Rules of Procedure of the Assembly in calling and conducting the session of 16 and 18 September, moderating the debate, without any violation or breach of ethics, despite the tense situation in the plenary session hall by a group of parliamentary opposition deputies. The Speaker of the Assembly has meticulously implemented the procedural steps provided for in Article 110 of the Rules of Procedure of the Assembly, but it has been proven that it was the obstructive actions of the opposition deputies, carried out in violation of the legal provisions of the Rules of Procedure of the Assembly and the provisions of the Code of Ethics, that have seriously violated the normal development of the plenary session and have become the cause for its non-compliance.

Based also on the decision of the ECHR of May 17, 2016, the case “Karacsony and Others v. Hungary”, as analyzed above, the right of expression of deputies competes with the principle of the normal and effective functioning of the Assembly and according to Article 76, paragraph 1, of the Constitution, it is the President of the Assembly who chairs the debate, directs the proceedings, ensures respect for the rights of the Assembly and its members, etc. It was the created situation that objectively led the President of the Assembly to continue the voting process to guarantee the implementation of the agenda for the voting of the political program and the composition of the Council of Ministers.

Some opposition MPs, with their behavior, have caused problems in the normal development of the plenary session due to blocking the rostrum and preventing the presentation of the political program by the Prime Minister, according to the established order of the plenary session. This has also prevented other MPs from all parliamentary groups from exercising their constitutional right and obligation to ask questions and discuss the program.

The behavior of some opposition MPs in not allowing the normal development of the session violates the integrity and image of the mandated members, and damages the image of the Assembly as the most important institution in a parliamentary republic for the law-making process, for the representation of citizens . /CNA
