Jack Smith seeks dismissal of cases against President-elect Donald Trump

Special Prosecutor Jack Smith asked a federal judge on Monday to dismiss the case against former President Donald Trump on charges of conspiring to sway the outcome of the 2020 election.

Mr. Smith said his decision is based on an early Justice Department practice of not bringing criminal charges against presidents while they are in office.

The decision marks the end of a landmark effort by the Justice Department to hold Mr. Trump accountable for what prosecutors call a conspiracy to keep him out of office that culminated in his supporters' attack on the Capitol on January 6. of 2021.

In the documents presented to the court, prosecutors state that according to the Department of Justice, "The Constitution requires that this case be dismissed before the defendant takes office."

This was an expected decision after Mr. Smith's team had begun considering alternatives to how to dismiss the two indictments it had brought against Mr. Trump, that of interference in the 2020 election and that of classified documents found in home after leaving office.
