US Immigration Court Allows Deportation of Palestinian Student

A U.S. immigration judge has ruled to allow the deportation of Palestinian activist Mahmoud Khalil. The ruling allows the Trump administration to continue its efforts to remove the Columbia University student, who was arrested in New York, from the U.S. The decision by Judge Jamee Comans of the LaSalle Immigration Court in Louisiana was not a final determination of Khalil's fate.

Citing the Immigration and Nationality Act of 1952, Trump-appointed Secretary of State Marco Rubio determined last month that Khalil could harm American foreign policy interests and should be deported for his "otherwise lawful" speech and activism.

The judge denied a motion by Khalil's lawyers to call Rubio and ask him about the "reasonable basis" he had for his designation under the 1952 law.

Comans said she did not have the authority to overturn a secretary of state. The judge denied a motion by Khalil's lawyers to subpoena Rubio and ask him about the "reasonable basis" he had for his designation under the 1952 law.

Khail, born in a Palestinian refugee camp in Syria, holds Algerian citizenship and became a legal permanent resident of the United States last year. Khalil's wife is a U.S. citizen. For now, Khalil remains in a Louisiana jail, where federal authorities transferred him after his arrest on March 8 to his apartment building at Columbia University, about 1,200 miles (1,930 km) away.
