Olsjan Çela targets KLP: Defective interaction

Prosecutor General Olsjan Çela in the Committee for Civic Initiatives, Cooperation and Institutional Oversight has targeted the KLP, stating that there have been problems between the two institutions regarding the manner of interaction, which Çela has assessed as defective, due to the movements of prosecutors, their temporary assignment which, according to him, should be done in coordination with the Prosecutor General.

He stressed that accountability is essential, bringing up the case of a prosecutor who, according to him, should have taken disciplinary action for the manner and language used in an appeal against the Court of Appeal's decision.

According to him, a disciplinary measure in this case would prove that the disciplinary responsibility system works.

"I was the first to point out to the committee the problems we had with the KLP regarding the manner of interaction, which was defective due to the movements of prosecutors, the temporary assignment, which in my opinion should have been done in coordination with the Prosecutor General, as he is the one responsible for the proper functioning of the system and if movements are made without prior consultation, then the mechanism has failed.

It was one of the issues we wanted to add to the recently signed memorandum of cooperation, which provides for a prior consultation mechanism on issues of this nature.

I think accountability is essential.

There are two moments that I wanted to capture: how disciplinary cases and proceedings are evaluated. I will give a case, an issue that I raised last year, of a prosecutor, who in an appeal used unacceptable language about a decision of the Court of Appeal and with this she also addressed institutions that have no connection to justice. She deserved a minimal measure, even a symbolic remark, to prove that the disciplinary responsibility system works. This system also failed. There is a problem with how the responsibility that members have is perceived”, said Çela./ CNA
