
The justice reform claimed that it would bring faster, fairer trials to Albania, less corruption in the justice system, a major fight against crime and corruption, and perhaps even a faster solution to citizens' problems.
For the troubles and injustices of the day, administrative matters. Everything that happens in a state office, a problem in a ministry, in an institution, a decision made by the state, which must be taken to the Administrative Court.
In fact, this is not the case. It is not that citizens have gained time with the new court decisions from the Justice Reform, especially in the administrative aspect. The Administrative Court is more bureaucratic, more incompetent and more unjust.
CNA has strongly supported the Justice Reform, especially the Special Structure (SPAK) as an institution. To be clear, not all SPAK prosecutors are the same, not all have the standard of Altin Dumani, which should be the level required of prosecutors of this institution.
There are prosecutors in SPAK who swear on "Xhafaj's head" and sleep on files, but that belongs to another article.
The situation in the Administrative Court is abuzz. It is not that there are no judges in this institution who work with justice quickly and are not corrupt, as corruption has not disappeared not only there but also in other courts.
But there are also incompetent judges. We have supported the Justice Reform, but CNA will denounce each judge on a case-by-case basis for incompetence, endless postponements of hearings, delays in resolving or dragging out simple cases that undoubtedly bring about corruption or are done for corrupt purposes.
We are bringing a concrete case to show that the facts are glaring in the Administrative Court.

A citizen is stopped with his vehicle for a violation of the Highway Code and for this reason he has been imposed two administrative fines and his license has been revoked for one year. Although he is a family man, with the car he needs for work reasons, the OASH (Road Police Commission) decided that after the policeman in the field, citizen BP's license should be revoked for one year.
These administrative decisions were issued in July 2025. Immediately after their disclosure through his lawyer, the citizen decided to appeal the case, to request the annulment of the OASH decision, but this went to the Administrative Court of Tirana, on July 4, 2025.

Pra nga nesër ose të hënën, në 8 korrik, mund të shkojë te komisariati përkatës i Policisë Rrugore për të marrë lejen e drejtimit dhe të vazhdojë të drejtojë mjetin.
Ndërkohë që në Gjykatën Administrative të Apelit, gjyqtarja Dorentina Mulaj, e mban dosjen në sirtar dhe padia e bërë nga qytetari, pasi ka kaluar një vit ka rënë, sepse ka kaluar afati i kohës së masës. Çështja ka rënë.
Qytetarët kur shkojnë në Gjykatën Administrative kërkojnë të drejtën e tyre dhe në rast se i është hequr patenta për një vit kërkon zbutjen ose heqjen fare të asaj mase.
Gjykata e merr e fut në sirtar e mban aty, ndërkohë që gjykata ndodhet në Tiranë qytetarët nga Korça, Gjirokastra, Vlora, Shkodra, Kukësi, Dibra apo anë e kënd Shqipërisë, shkojnë 20 herë, thirren, anullohen seanca, shtyhen, qytetari dhe pret vendimin. Koha kalon kostot shkojnë miliona lekë. Po a e mendon këtë gjykatësi/ja adminisatrative.
Afatet e dënimit administrative kalojnë pa u zhvilluar ende gjyqi. Qytetari përveçse do të paguajë gjobën, do vuajë pezullimin një vit të patentës, duhet të shpenzojë miliona lekë me shpresën se do të gjejë drejtësi. Do të paguajë miliona lekë për të shkuar në Tiranë, për të gjetur avokat, për tu paraqitur. Vajtje-ardhje dhe sorollatje, shumë herë humbje kohe, miliona lekë dëm.
Pse? Sepse gjyqtarët administrativë, raste të tilla që mund t’i kenë thjesht një punë rutinën 10 minuta në ditë i marrin dhe i lënë mënjanë.
Pse? A nuk janë kosto për qytetarët këto? A mund të ketë një qytetar që është dënuar për një çështje administrative në mënyrë të paligjshme? Pse nuk duhet të kërkojnë drejtësinë? Pse zvariten?
Sepse gjyqtarët tanë administrative nuk mund të harxhojnë kohën me çështje “banale” patentash, se nuk e kuptojnë që qytetarët më ato patenta sigurojnë bukën e gojës, sigurojnë të shkuarjen e përditshme në punë. Sot pa makinë jeta është shumë herë më e vështirë.
Gjyqtarët administrative nuk i kapin me dorë këto raste, i lënë t’ju kalojnë të gjitha afatet.

Çfarë fitoi qytetari të cilit ju hoq në mënyrë të padrejtë patenta nga një polic dhe një OASH? Jo vetëm pagoi gjobën, jo vetëm kaloi afati për një vit por detyrohet të shkojë dhe 20 herë në Tiranë.
Dorentina Mulaj vazhdon të jetë në Gjykatë Administrative duke bërë sehir. Si kjo çështje ka dhe të tjera. Nuk është i vetmi rast. Janë me qindra e mijëra ato të qytetarëve që kanë çështje të vogla administrative.
From the waterworks, OSHEE, to the police, municipalities and the Administrative Court, they just sleep. They take on big issues quickly, where there is a lot of money. But for the small problems of citizens, there is no speed or justice. Delayed justice is never justice.
A matter that can be handled very quickly by browsing 5 documents in 10 minutes is not handled by the Tirana Administrative Court, which in this case is in flagrante delicto not only with Ms. Mulaj but with dozens and hundreds of other cases, which we will bring day after day.
Not only to say that the Justice Reform has not brought solutions to problems for citizens, but has increased their worries and costs of going to Tirana more often to pay more money to lawyers and in the end to receive nothing in response.
This is because the judge does not even dare to open the file to respond. But she schedules and postpones hearings and in the meantime, in this specific case, the administrative measure ends and the Court is out of the game, increasing costs and not holding any responsibility for the injustice done to the citizen. /CNA
