The head of the Criminal Lawyers Association, Joana Qeleshi, spoke this evening regarding the arrest of lawyer Ulian Barjami, who was released a few hours ago. Qeleshi said in a television appearance that the lawyer's detention was illegal. She added that in court hearings there can be debates or conflicts but added that there are other measures that can be taken before the arrest.

"It was a strange event. We all perceived that the prosecutor had filed a report. Because the judicial police officer cannot take the initiative for detention. It can happen in a process that there is a conflict or debate. The reaction of the court and the prosecutor should be very measured. If there were elements of any criminal offense, the court or the prosecutor should have filed a report. The detention was illegal. We still have the concept that the prosecutor arrests you, but the court is the one that decides on a security measure.

"The law states that the judicial police officer must immediately notify the available prosecutor and say that we have made this arrest. The lawyer was released within the 48-hour limit, and this is due to the fact that the judicial police did not forward the materials. From this perspective, this is an unfortunate situation. We must understand that in the hearing the lawyer will have a defensive stance and there may even be a debate. And the prosecutor can draw attention, there are other measures that are taken ," said Qeleshi. /CNA
