Funeral agencies will be opened with a license/ Here is the deadline for meeting

The Council of Ministers approved this Wednesday some changes in the decision on funeral service agencies.

The changes provide for the licensing of funeral service agencies by municipalities for the exercise of funeral service activity and/or the provision of service for funeral homes.

Within 6 months, the local self-government units must approve the additional criteria and conditions that the agencies must meet regarding technical capacities and human resources.

If agencies do not meet these criteria within 6 months of their approval, then they are not licensed.

So, funeral service agencies that are currently operating must meet the criteria and conditions for licensing, within 6 months of their approval by the municipalities.

DECISION ON SOME ADDITIONS AND CHANGES IN DECISION NO. 711, DATED 29.10.2014, OF THE COUNCIL OF MINISTERS, "FOR THE APPROVAL OF THE REGULATION "FOR THE ADMINISTRATION AND OPERATION OF CEMETERIES IN THE TERRITORY OF THE REPUBLIC OF ALBANIA""

In support of article 100 of the Constitution and point 2, article 3/d, of law no. 9220, dated 15.4.2004, "On the administration of the funeral service", amended, with the proposal of the Deputy Prime Minister and Minister of Infrastructure and of Energy, Council of Ministers

DECIDE:

I. In the regulation "On the administration and operation of cemeteries in the territory of the Republic of Albania", approved by decision no. 711, dated 29.10.2014, of the Council of Ministers, the following additions and changes are made:

1. After point 21, of article 3, point 22 is added, with the following content:

"22. The "funeral house" is the environment invisible from the outside, which serves as a reception house for the performance of farewell rituals and other rites in honor of the dead."

2. In Article 36, the following changes and additions are made:

a) The first sentence, of point 2, is changed as follows:

"Funeral service agencies are licensed by local self-government units for the exercise of funeral service activity and/or the provision of service for funeral homes, in the direction of:...".

b) After point 3, point 4 is added, with the following content:

"4. The local self-government units foresee the additional criteria and conditions that the funeral service agencies must fulfill for the exercise of the funeral service activity and/or the provision of the service for funeral homes, in relation to technical capacities and human resources.".

3. In Article 39, the following changes and additions are made:

a) Item 3 is amended as follows:

"3. Agencies and funeral homes must carry out the activity, such as: completing formalities, selling funeral items and any other activity related to the funeral, within the approved premises and which are not visible from the outside.

b) After point 4, point 5 is added, with the following content:

"5. Local self-government units control funeral service agencies and funeral homes for fulfilling and respecting the conditions and criteria for the exercise of their activity, provided for in this decision and in the rules established by local self-government units, regarding technical capacities and resources. human.".

II. TRANSITIONAL AND FINAL PROVISIONS

1. The local self-government units, within 6 (six) months from the entry into force of this decision, must approve the additional criteria and conditions that the funeral service agencies must meet for the exercise of the activity in relation to technical capacities and human resources.

2. The agencies, which exercise their activity before the entry into force of this decision, must meet the criteria and conditions for licensing, within 6 months from their approval by the local self-government units.

3. If after the 6-month period from the date of approval of the rules established by the local self-government units, the agencies do not meet the established criteria and conditions, they are not licensed.

4. The Ministry of Infrastructure and Energy and local self-government units are charged with the implementation of this decision.
