Balluk's suspension/Rama: The only case in the world, a usurpation of the

Prime Minister Edi Rama has reacted on social media regarding the Albanian government's complaint regarding the suspension of Belinda Balluku from office.

In his speech, Rama said that the suspension was appealed by him not as an individual, but in his capacity as Prime Minister.

A complaint that Rama said came about for the principle of non-interference of one independent power in the composition of another independent power, so as not to violate the balance between powers.

Rama called the complaint an institutional battle to ensure that the balance between powers is not violated.

The Prime Minister called Balluk's suspension an anti-democratic attempt and said that not fighting at the highest levels of the judiciary shows irresponsibility.

Rama did not leave the opposition without irony, saying that you have to be blind to turn a conflict of competences into a political conflict, as the drowned in the swamp are doing.

The Prime Minister stated that the suspension of a member of the government by the court is the only case in Europe and the world. He called the decision to suspend by the prosecutor and the judge a usurpation of the Prime Minister's competence.

Pressure from the court? The Prime Minister should not talk about a judicial process. Apparently, we have not understood each other and that is why I am starting with the question: Do you know who has appealed to the Constitutional Court the suspension of the minister by a prosecutor and a judge? I have appealed, of course as Prime Minister and not as Edi Rama and of course not for an individual, a minister, who in this case is also the Deputy Prime Minister, but for the principle. For the principle of non-violation of the balance between powers. For the principle of non-interference of another independent power in the composition of the independent executive power. For the principle of non-taking of the competencies of the Prime Minister and the President by a prosecutor and a judge. In short, this is an institutional battle to prevent what the Venice Commission considers an impermissible violation of the dividing line between powers. I am a party and I speak as a party. I do not put pressure on the accused and I do not speak about a judicial process that is unrelated to my role. I speak for the public, for a process that decides the balance between independent powers in Albania. For the Constitutional freedom of the Prime Minister in the Republic of Albania to decide on the executive and its composition. For the exclusive right of the parliament to approve or not the composition of a government.

Duhet të jesh i papërgjegjshëm karshi Shqipërisë, për ta lënë pa luftuar gjyqësisht në shkallët më të larta këtë tentativë anitdemokratike. Aq më keq akoma, duhet të jesh krejt i verbuar për ta kthyer këtë konflikt kompetencash në një konflikt politik. Siç bëjnë për çdo hgjë të mbyturit e kënetës. Fakti është se ndërkohë që hidhen përpjetë mbi llumin e tyre për ta kapur nga duart e prokurorëve ushqimin për opozitarizmin, në këtë rast nuk e tregojnë dot.

 

In this case, they cannot show a single case in Europe or even in the world, where a member of the government was suspended by a court decision, by a prosecutor and a judge. The truth is that they cannot find one because there is none. They do not know how and where to get it, because the suspension of a minister on the initiative of a prosecutor and a judge's decision is a usurpation of the prime minister's competence. In addition to this, it is absurd, totally as a concept. Because de jure it is called suspension but de facto in the case of the minister it is a dismissal, which the prime minister only has to formalize since the prosecutor thought of it and the judge decided, because suspending a minister does not mean suspending a public official of any level. You can do that because someone else does the job, but it means annihilating an authority with exclusive decision-making power without a deadline. If the minister is suspended, the deputy minister cannot exercise the exclusive authority that the Constitution gives only to the minister to represent the sector and to propose decisions to the government almost weekly. I do not want to go into the arguments and theories about the reason for this legal battle. Anyone who does not understand how simple it is that this is not about Belinda Balluku, nor about me and the government today, but about the protection today and forever of the constitutional boundaries between powers, then there is no way they understand. Or else they want their own shortsightedness not to understand. So as a party in the process representing the Prime Minister's Office, the state and public interest of my temporary function, not the personal interest of the suspended minister, I want to remind you all of one thing, the obligation to clarify public opinion regarding issues in the public interest or my institutional positions, I consider non-negotiable. Even when it comes to a judicial process, for which public opinion is interested in knowing my opinion. No one prevents me from explaining myself to those who have put me in this position. Those who have no idea about the way I function in relation to my obligations to the country and those people can say whatever they want. I repeat my wish that the Constitutional Court spares Albania the invention of a totally unwelcome innovation, in the history of democratic justice or even world justice if you like./CNA
