OSCE-ODIHR recommendations for the May 11 elections revealed

The OSCE-ODIHR mission has shared several recommendations, separated into several categories, regarding the May 11 parliamentary elections.

The recommendations are based on several aspects: election administration, use of technology in elections, voter registration, campaign finance, and the media. 

The OSCE-ODIHR has also shared several priority recommendations based on the electoral process.

Priority recommendations

-To address the unfulfilled ODIHR recommendations, as well as various ambiguities and inconsistencies, the electoral legal framework should be comprehensively reformed through an inclusive consultative process, well in advance of the next elections, in line with international standards and good practices.

- To ensure the stability of the election administration, consideration should be given to depoliticizing the appointment procedure for lower-level election commissions, as well as limiting arbitrary and last-minute replacements of commission members, to guarantee proper and timely training for all members.

- To strengthen the capacity and professionalism of the Ballot Counting Teams, the CEC should organize specific training sessions on counting procedures and develop a standardized training curriculum, including easy-to-understand manuals and information sheets on the counting process.

- Voter education efforts on electronic voting should be intensified, with a focus on increasing voter awareness of electronic voting procedures and ensuring that all voters are able to vote independently.

- To eliminate any ambiguity in the legislation regarding the campaign, the use of administrative resources for electoral purposes should be prohibited from the moment the elections are announced until voting day.

- To ensure a level playing field, authorities should take measures to prevent the misuse of state power and resources. Proportionate and punitive sanctions should be imposed swiftly for such violations.

- In accordance with good practices, the law should clearly define which pre-election activities constitute campaign expenses, so that they are subject to reporting, supervision and appropriate sanctions.

-Film materials produced by political parties or government authorities should be clearly labelled as political advertising and therefore banned from news programmes and editorial content. Effective measures to address violations should be in place and implemented in a timely manner.

Electoral Administration

Për të forcuar kapacitetin dhe profesionalizmin e komisioneve zgjedhore të niveleve më të ulëta, KQZ duhet të zhvillojë një kurrikul të standardizuar trajnimi, duke përfshirë manuale dhe fletëinformime të thjeshta për proceset.

- Gjatë përcaktimit të vendndodhjeve të qendrave të votimit, autoritetet zgjedhore dhe bashkitë duhet të marrin masa proaktive për të siguruar aksesueshmëri të plotë për personat me aftësi të kufizuara.

- Për të siguruar pjesëmarrje më të gjerë të grave, KQZ duhet të garantojë që komisionet zgjedhore të niveleve të ulëta të jenë të balancuara gjinorisht, duke përfshirë edhe emërimin e grave në pozicione drejtuese.

Përdorimi i Teknologjisë në Zgjedhje

- Për të mbrojtur integritetin dhe për të rritur besimin publik, vendimet për përdorimin e teknologjisë në zgjedhje duhet të respektojnë kuadrin ekzistues rregullator dhe të mos merren nën presion politik.

- Nëse në të ardhmen merret në konsideratë zgjerimi i votimit elektronik, përdorimi i teknologjisë duhet të menaxhohet në mënyrë gjithëpërfshirëse, transparente dhe të integruar.

Regjistrimi i Votuesve

- Për të respektuar standardet ndërkombëtare dhe për të garantuar të drejtën universale të votës dhe trajtimin e barabartë para ligjit, të gjitha kufizimet e së drejtës së votës bazuar në aftësi të kufizuara intelektuale ose psikosociale duhet të hiqen, përfshirë ato të bazuara në vlerësime individuale nga gjykatat.

Fushata Zgjedhore

-Pas konsultimeve gjithëpërfshirëse me palët e interesuara, aktivitetet e fushatës dhe reklamat politike në rrjetet sociale, përfshirë financimin e tyre, duhet të rregullohen duke respektuar të drejtën e lirisë së shprehjes.

- Për të mbrojtur shprehjen e lirë të vullnetit të votuesve, organet e rendit duhet të bëjnë çdo përpjekje për të identifikuar dhe hetuar të gjitha akuzat për shkelje zgjedhore, në mënyrë të plotë, të shpejtë dhe transparente. Votuesit duhet të informohen sistematikisht për mekanizmat e raportimit të shkeljeve, përfshirë mbrojtjen e sinjalizuesve dhe garancitë kundër hakmarrjeve.

-Për të rritur pjesëmarrjen politike të grave, financimi publik mund të lidhet me masa konkrete gjithëpërfshirjeje. Partitë politike duhet të konsiderojnë reforma të mekanizmave të brendshëm për të rritur përfaqësimin e grave në strukturat e partive, përfshirë aksesin në fonde.

Financimi i Fushatës

-Për të siguruar kushte të barabarta gare, korniza ligjore duhet të përfshijë një tavan të arsyeshëm për shpenzimet e fushatës për kandidatët që garojnë në lista partie ose koalicioni.

-Për të rritur transparencën, autoritetet duhet të konsiderojnë rregullimin e fushatave online dhe të palëve të treta, përfshirë entitetet e lidhura me partitë politike, si dhe përcaktimin e kushteve përkatëse për raportim dhe mekanizma sanksionues.

-To strengthen transparency and accountability, the CEC should be given additional financial and human resources, as well as an expanded mandate, to enable a full audit of campaign financial reports, including the power to investigate the sources of donations.

Media

-State authorities, in order to fulfil their positive obligations under international law, should promote an independent and diverse media environment, free from political and corporate influence. A comprehensive regulation on media ownership should be adopted and its effective implementation strengthened. Measures should also be implemented to protect editorial autonomy from political and business influence.

-Legal amendments should ensure effective depoliticization and genuine institutional independence of the public broadcaster and the Audiovisual Media Authority, in line with international good practices. These amendments should include broad public consultations with independent media and civil society representatives.

-Defamation should be fully decriminalized and civil defamation provisions brought into line with international standards for freedom of expression.

-The Electoral Code rules for the allocation of television time in editorial coverage should be amended to reduce the advantage given to the largest parliamentary parties and to ensure a fairer distribution of space for all contestants.
