VKM/ Ownership of the 'Niko Dovana' stadium in Durrës changes

The Albanian government decided today to transfer ownership of state-owned properties to the joint-stock company "Albanian Investment Corporation", for the implementation of the investment project "Revitalization of the "Niko Dovana" Stadium, Durrës".

DECISION

ON THE TRANSFER TO THE ALBANIAN INVESTMENT CORPORATION OF STATE PROPERTY FOR THE REALIZATION OF THE INVESTMENT PROJECT “RENOVATION OF THE “NIKO DOVANA” STADIUM, DURRES ”

In support of Article 100 of the Constitution, point 1, Article 7, of Law No. 71/2019, “On the Albanian Investment Corporation”, and letter “b”, point 1, Chapter II, of Decision No. 137, dated 6.3.2024, of the Council of Ministers, “On determining the criteria and procedure for granting state property for rent, emphyteusis, leasing, sale, use as collateral and use in other forms by the Albanian Investment Corporation”, as amended, upon the proposal of the Minister of Economy, Culture and Innovation, the Council of Ministers.

DECIDED:

Authorization of the joint-stock company "Albanian Investment Corporation", sh.a., itself or through the entity created by it, to act as a developer of the properties specified in annexes no. 1 and no. 2, attached to this decision, and the authorization granted by the Durrës Municipal Council through decision no. 125, dated 27.7.2023, in function of the implementation of the investment project specified in point 1 of this decision, which aims, among other things, to fulfill the public interest.
The Albanian Investment Corporation and the institution specified in Annex No. 3, attached to this decision, or the authorities authorized by them, are authorized to, within 30 (thirty) days from the entry into force of this decision, conclude cooperation agreements to determine the standard, methodology, terms and conditions of cooperation for the fulfillment of the public interest, the fulfillment of the interest of the Corporation, as well as the entities in whose ownership the new state property is registered.

The Albanian Investment Corporation is authorized to open a competitive procedure for the selection of the private partner, according to the rules set forth in decision no. 137, dated 6.3.2024, of the Council of Ministers, "On determining the criteria and procedure for the lease, emphyteusis, leasing, sale, use as collateral and use in other forms by the Albanian Investment Corporation", as amended, for the development of property through the entrepreneurship instrument.

The Albanian Investment Corporation is authorized to negotiate with private entities, with the aim of concluding the relevant contract for the development of properties transferred to ownership or for which there is a development authorization, in order to implement the investment project.

The Albanian Investment Corporation is authorized, by itself or through entities created by it, to carry out actions with the State Cadastre Agency, public institutions competent for territorial planning and development or with other institutions, within the framework of the implementation of the investment project, as well as to ensure the registration, on behalf of the Republic of Albania/Municipality of Durrës/Corporation, according to the provisions of the cooperation agreement, of the new state property that will be created within the framework of the investment projects.

In order to develop the properties specified in this decision, in accordance with the relevant legal provisions for territorial planning and development, the Albanian Investment Corporation is authorized to proceed with the demolition of the buildings, part of the properties specified in Annexes No. 1 and No. 2, attached to this decision.

Decision no. 485, dated 1.8.2023, of the Council of Ministers, "On the assignment of the Albanian Development Fund as the contracting authority for the implementation of the project of the multifunctional area around the "Niko Dovana" stadium complex in Durrës, including the stadium", is repealed.

The Municipality of Durrës, the Albanian Football Federation, the Ministry of Education and Sports, the Albanian National Olympic Committee, the State Cadastre Agency and the Albanian Investment Corporation are responsible for the implementation of this decision.
