The head of the Parliamentary Group of the SP, Bledi Çuçi, has reacted in relation to the decision of the Constitutional Court not to send the mandate of deputy Olta Xhaçka to the Venice commission.

Çuçi said that he feels sorry for the decision, while declaring that the Constitutional Court has tried to create a new legal norm, which the Constitution does not allow.

He insisted that the Socialist Party will request an opinion from the Venice Commission on Xha?ka's case.

"The issue of the report of the Parliament with the CJK I think is a report that is clearly defined by the Constitution. The GJK has the authority to annul any law, decision, act, taken by the Assembly if it deems it to be in conflict with the Constitution.

There was a decision of the CJK that annulled 2 decisions of the Assembly, and the Assembly undoubtedly does not discuss the decision, but it did annul them.
In this particular case, there is an ambiguity about the fact that one deputy or all should vote in a certain way, forced by a decision, not by what they think. This is a debate that has not found a solution even with the decision of the GJK.

On the contrary, the CJK in our judgment has tried to create a new legal norm, which the Constitution does not allow. It just has to judge the existing norms. Deputies have the right to vote as they see fit. He knows the Constitution. The deputy is not even responsible for his vote, as provided for in Article 73. We thought of asking the Venice Commission for a final opinion to resolve the impasse," he said./ CNA
