Draft for the new Criminal Code/ Lamallari: The process of opinions and comments

The Ministry of Justice held a meeting today with representatives of justice institutions regarding the new Criminal Code.

In his speech, Lamallari said that the need for a new Criminal Code comes from the dynamics and new context in which Albania finds itself.

Further, Lamallari said that cooperation and coordination between justice institutions for the new Criminal Code is essential.

 

" The Criminal Code is one of the most fundamental acts of our legal system and as such must inevitably reflect the realities of the time, new dynamics, the evolution of jurisprudence, international standards and of course the expectations of citizens for more security and justice. The need for a new Code is dictated by the dynamics and new context in which our country finds itself, three decades after the conception and adoption of the existing Code. Our priority is to build a Criminal Code that guarantees the protection of fundamental human rights and freedoms, strengthens the fight against crime and prevents illegal activities, from the simplest to the most complex, from traditional forms to those that have emerged in recent years. Therefore, cooperation and coordination between us are essential. Our aim is, through this process, to identify every deficiency, every ambiguity and every aspect that can be improved, so that the new Code is a more effective, modern and sustainable instrument for the decades to come", said Minister Lamallari.

 

Minister Lamallari also spoke about the public consultation phase, where he said that the process of providing opinions or comments needs to be concluded within three months.

This phase will be followed by a second phase of meetings at a technical level, a phase that will be concluded within the first half of 2026.

 

" In order to allow the European Commission the necessary and reasonable time to review the final draft and then follow parliamentary procedures until its approval during the second half of next year, it is necessary to conclude the process of obtaining opinions or written comments within the next three months to enable a second series of meetings at the technical level with the aim of reconciliation with the contributing institutions within the second quarter of 2026 ," said Lamallari.
