Draft Criminal Code/ Manja: The Ministry of Justice is the commissioner, not the

 

The Minister of Justice, Ulsi Manja, at the roundtable called for a public discussion regarding the Draft of the New Criminal Code has clarified the role of the institution he leads in this process. Manja stated that the Ministry of Justice is the commissioner, but not the writer of the draft. The drafter is the director of the Magistrates' School Arben Rakipi, assisted and consulted by experts and the Codification Directorate at the Ministry of Justice.

The minister has also responded to the criticism.

"Give us the opportunity to once again inform the public opinion that is interested in participating in the public consultation of the Draft of the New Criminal Code. Since July, there have been discussions on specific aspects of the draft. We have kept a record of all the analyses since the publication of the draft. Several Civil Society organizations have submitted a request to participate in some specific topics, on some of its aspects.

The role of the Ministry of Justice is that of the commissioner of the draft of the New Criminal Code, as a fulfillment of our obligations in the negotiations for EU integration.

There are two paths to drafting a law like the Criminal Code: either through the Codification Directorate or through the Justice Institutions. We have chosen the latter.

Immediately after the justice reform, the 2017-2021 Strategy was adopted and in point 4 it is stated that Albania will take steps to improve criminal legislation. In February 2019, the first initiatives were taken for changes to the Criminal Code, which would be partial.

Due to the numerous changes, it was concluded that a new Criminal Code needed to be drafted. The Code was drafted by Arben Rakipi with the input of experts and then concluded at a roundtable in 2020 with participants from justice institutions.

In 2023, I set up a working group not to write the new code, but to look at some indicators, I gave the working group a deadline of the end of 2024. During the period October 2024-February 2025, a series of meetings were held with interested stakeholders and interest groups, about 40 of them with experts in the field. The draft was submitted to the Codification Directorate according to the deadline. On July 25, we had the first roundtable.
