Fatmir Mediu, officially under investigation for the

Special Prosecutor's Office against Corruption and Organized Crime, Tirana, on the basis of decision no. 205, dated 24.09.2021 of the Special Court of Appeal for Corruption and Organized Crime, Tirana (which decided to revoke decision no. 6, dated 14.09. .2009 of the Criminal College of the Supreme Court for the dismissal of the criminal case against the defendant Fatmir Mediu), has registered the criminal proceeding no. 279 of 2021 and has conducted the preliminary investigations related to this criminal proceeding.

Në përfundim të hetimeve paraprake është paraqitur në Gjykatën e Posaçme për Korrupsionin dhe Krimin e Organizuar kërkesë për dërgimin në gjyq të çështjes penale nr.279 viti 2021, në ngarkim të të pandehurit Fatmir Mediu, i akuzuar për veprën penale “Shpërdorimi i detyrës”, e kryer në bashkëpunim, parashikuar nga nenet 248 dhe 25 të Kodit Penal, si dhe për kryerjen e veprës penale “Shpërdorim i detyrës” në bashkëpunim me subjekt ushtarak-kuadër komandues, parashikuar në nenet 70/2 e 2 të Kodit Penal Ushtarak dhe neni 25 i Kodit Penal.

I pandehuri Fatmir Mediu akuzohet se në lidhje me proçesin e çmilitarizimit dhe çmontimit të municioneve që është zhvilluar në ambientet e ish “Brigatës së Tankeve”, në fshatin Gërdec, Bashkia Vorë, në bashkëpunim me funksionarë të tjerë të Ministrisë së Mbrojtjes si dhe persona që kanë pasur cilësinë e ushtarakut kuadër komandues, ka nxjerrë disa akte nënligjore në kundërshtim me ligjin dhe V.K.M Nr.138, date 14. 03. 2007 “Per proçeduren e trajtimit te armeve, teknikes dhe pajisjeve te forcave te armatosura, te hequra nga armatimi dhe perdorimi, persa i perket shitjes per çmontim dhe çmilitarizim te nje sasie municioni”, të cilat kanë dëmtuar interesat e ligjshme të shtetit dhe kanë sjellë avantazhe të padrejta për shoqëritë SAC inc dhe Albademil sh.p.k.

During the investigations of this criminal proceeding, further actions were also carried out in relation to the procedure of the sale of military ammunition by the Ministry of Defense and the company "MEICO" to the foreign companies "Evdin" ltd, with headquarters in Cyprus and "AEY", with headquarters in Florida.

Regarding this episode, the preliminary investigations have not been completed and the division of the criminal case has been decided, registering criminal proceedings no. 279/1 of 2023, for the criminal offenses "Passive corruption of high state officials or local elected officials" and " Cleanup of the proceeds of a criminal offense or criminal activity", provided by articles 260 and 287 of the Criminal Code.
