Osmani seeks clarification from the Constitutional Court on what happens if the

Kosovo President Vjosa Osmani announced that she has addressed the Constitutional Court to seek clarification on what will happen if the Kosovo Assembly is not constituted by July 26 – the deadline set by the court earlier in a ruling. She has also requested a temporary measure to suspend the 30-day deadline.

"Our request today, in essence, is a request for clarification of the legal consequences of not constituting the Assembly within the constitutional deadline of 30 days," Osmani said at a press conference.

The Constitutional Court of Kosovo on June 26th obliged the deputies to constitute the legislative body by July 26th.

Osmani recalled that in the preliminary ruling of the Constitutional Court regarding the failure to constitute the legislative body after the February elections, the legal consequences were not clarified.

According to her, the goal is to clarify the situation of failure to constitute within the deadline, but also how the powers of each constitutional institution are exercised, in the absence of the constitution of one of the main pillars of the principle of separation of powers, which is the Assembly.

Also, "it must be clarified what happens if the Assembly is constituted after July 26," she said, adding that this request is intended to prevent damage that could be caused.

Osmani said that in the request sent to the Constitutional Court, which concerns the resolution of the conflict of powers, he also submitted a request for a temporary measure to suspend the 30-day deadline.

"The request for a temporary measure is an opportunity to avoid putting institutions in an endless blockade, and entering a situation where institutions could be constituted in an unconstitutional manner and would be untimely," said the head of state.

She added that a suspension of the term would prevent the violation of the Constitution by MPs, the constitution of the Assembly after the term, which would be unconstitutional, and the possibility of electing a government, which would also be in violation of the highest legal act.

President Osmani said she hopes that the request for a temporary measure will be urgently addressed by the Constitutional Court.

"We hope that at least the part of the interim measure will be dealt with urgently, so that one or two days of this deadline remain unused, so that when the Court publishes the full decision regarding the legal consequences, among other things, then the deputies will have at least these two days to act in accordance with the Constitution," she said.

The Presidency will withdraw the request if the MPs reach an agreement on the constitution of the Assembly before the July 26 deadline, Osmani explained./rel
