Only 30% of files are saved from being thrown into the trash at the Sadushi

Amidst the professional arrogance and the expression "no one dares to change the decisions I make," there is an investigation that must be conducted by the prosecution and that directly affects the Albanian citizens whose troubles are brought to the Supreme Court where Sadushi commands.

SPAK has the competence and should investigate the criteria for how Sadushi selects when throwing out the complaints of Albanian citizens. For example, investigate how the figures for the evolution of non-admission decisions are presented from year to year.

To help you, we are providing some figures reported in the official Annual Reports of the Supreme Court.

During 2022, refusal decisions accounted for 74% of the Supreme Court's overall decision-making, but there is no reference to the division by nature of the cases.

During 2023, the non-admission decisions amounted to:

- 65% of the Court's overall decision-making.

Divided according to the nature of the issues, they included:

- 78% in administrative matters,

- 63% in civil matters and

- 51% in criminal cases.

For 2024, refusal decisions accounted for 73% of the Court's overall decision-making.

Divided according to the nature of the issues, they include:

- 70% in administrative matters,

- 68% in civil matters and

- 81% in criminal cases.

These figures can also be analyzed by comparing them with each other. Thus, the figure that unites them is an average of 70% of the total that are refused to be reviewed.

Even within the nature of the cases that are accepted, 3-year averages can be derived.

But what unites them most is that Sokol Sadushi's reports do not explain what happened to these 70% of the files that are thrown in the trash.

In three years, Sokol Sadushi has directed the acceptance for single consideration:

- 26% of files for 2022.

- 35% of files for 2023 and

- 27% of files for 2024.

Only an average of about 30% of files escape the scissors of disqualification by Sadushi.

By what criteria do they qualify as acceptable for review?

SPAK should investigate Sokol Sadushi's scissors practice.

From those files, a shortlist of lawyers representing the defendants in those files may also emerge.

And perhaps from that list we can understand the zeal with which a bunch of lawyers attack or defend Sokol Sadushi's lines of interest./ CNA
