New regulation for prosecutors enters into force, leading magistrates will

The High Prosecutorial Council (HPC) has approved the regulation that determines the manner of appointing prosecutors as leading magistrates in the professional practice program.

The regulation stipulates that the leading magistrates will receive a salary supplement of 5% above the initial gross monthly salary during the period they perform this task. In the role of mentor, the leading magistrate will guide and support the candidate for magistrates during their professional practice.

The regulation establishes the criteria for their selection, according to which prosecutors who will be selected as magistrates must have a minimum of 5 years of experience as a prosecutor, a minimum ethical and professional assessment of "very good", no disciplinary measures and completed training for leading magistrates and no disciplinary measures.

Also, he must have respected the legal deadlines for investigating or adjudicating cases during the last year.

According to the regulation published in the Official Gazette "On the appointment of prosecutors as leading magistrates in the professional practice program and on the ethical and professional qualitative assessment of candidates for magistrates", the leading magistrate is appointed for a period of 3 years.

Every year, the Council checks whether it meets the criteria through disciplinary information, the report from the prosecution, and the evaluation from the School.

Based on this review, the Council decides whether to continue or revoke the appointment as lead magistrate.

The presiding magistrate who supervises a candidate for magistrate does not participate in the 10th draw of lots for the allocation of cases, so he has less workload.

The head of the prosecution office must monitor the implementation of this rule and take this reduction into account in the annual performance evaluation of the presiding magistrate.

The candidate for magistrate is entitled to 25 working days of paid annual leave, of which 15 days during the month of August.

These 15 days of leave must be in the same period as the leave of the presiding magistrate.

Vacations are assigned by the head of the prosecution office, after consulting with the presiding magistrate who supervises the candidate's practice./ Monitor
