The plenary session of September 12 is expected to be decisive for the mandate of Olta Xhaçka. 

At today's meeting of the Council of Legislation, the opposition and the socialists agreed to ask the Speaker of the Assembly, Elisa Spiropali, to include in the first plenary session for decision-making by the Assembly the draft decision "On sending to the Constitutional Court the motion of no less than 1/10 of the MPs for finding the incompatibility of the mandate of the MP Mrs. Olta Xhacka".

"We have the obligation to act with priority, to respect and demand the implementation of the decision of the Constitutional Court. Through a mandatory decision of the Assembly, it should be sent to the Constitutional Court," said the president of the Legislation Council, Dhurata Çupi.

But the socialists and the opposition at this meeting were divided on one point. The Chairperson of the Council of Legislation, Dhurata Çupi, has drawn up a draft report with 4 points where she suggests to the assembly the steps to be taken to implement the decision.

For the socialists there is no need for such a report as they agree and according to them the report is made by the administration. 

The mandate of Olta Xhaçka must be reviewed without delay in the Constitutional Court and the deputies are obliged to send it as soon as possible, the Constitutional Court said in the decision made on July 10, 2024. The President of the Constitutional Court made it clear to the Assembly that it can never calls into question the binding force of its decisions.

The "Xhaçka" case has been sent to the Constitutional Court by the opposition, which claims that the socialist MP should be stripped of her mandate on the grounds of conflict of interest, due to her husband's investor status./ CNA
