Open letter to Mr. Fron Nahzi!

I am addressing you with this letter, as a reaction in the capacity of a former deputy of the Parliament of Albania until 1 year ago, as a former member of the Parliamentary Commission of Inquiry on the affair of the incinerators in Albania and as one of the permanent denunciators of this mega-corruption affair already for 4 years.

The reason why I am contacting you is to give a public answer, in relation to the article published by you a while ago, entitled: "Under Rama, Albania is failing in almost every aspect".

Mr. Nahzi in this article, among other things, surprisingly writes that: "Edi Rama, as the head of the Territorial Development Agency, signed the incinerator project, but has distanced himself from the scandal, saying that it has to do with the actions of individuals, not of his government".

And below your article continues: "No evidence has emerged that could incriminate him (Rama) for bribery or link him to offshore accounts, so often involved in concessions and construction projects."

This is not true at all and let me explain in detail why the truth is different, with concrete facts and evidence:

1 . Edi Rama, as chairman of the National Council of the Territory, not only signed the Tirana incinerator project, for the construction of which about 132 million euros have been paid so far and the incinerator does not exist, but Edi Rama personally as prime minister of the Republic of Albania after he came in power, declared a state of environmental emergency contrary to the law and replaced the waste treatment strategy, based on landfill, selection and recycling, drawn up with a financing of several million euros from the EU, with the new strategy of burning (incineration) of waste.

2. In the case of the Tirana incinerator, Prime Minister Rama, contrary to any law in force, on 7.12.2016, signed the granting of a bonus of 8 percent of points to the company "Integrated Energy BV" sh.pk for the competition procedure, for the construction of the Tirana incinerator, but in fact, as it has been made public in the Parliamentary Commission of Inquiry on this affair and in any visual or written media, this company did NOT EXIST when Prime Minister Rama signed the bonus that favored it in the competitive procedure.
Edi Rama signed this decision even after the Minister of State for Relations with the Parliament Mrs. Ermonela Felaj, with letter no. 6490/1, dated 15.11.2016, had officially opposed this procedure, as the company was not registered in the Republic of Albania according to the legislation in force, simply put, this company did not exist and was not registered in the National Business Center (NBC). I quote: "Unfortunately, despite searching several times, either by company name or shareholder name, we have not been able to find the company registered in the CKB. We recommend that the NIPT of the company be provided in the report along with some other financial data, such as Capital, division between partners, administrator, etc., where it is clear that the company has the necessary financial capital for such an investment".
In addition to this flagrant fact, Prime Minister Rama signed the bonus of 8 percent of points for this non-existent company even after the Minister of Justice, Mr. Ylli Manjani, with letter no. 7358/1 Prot., dated 15.11.2016, objected to this draft decision of the Council of Ministers, which clarified that the granting of the bonus to the company that would build the Tirana incinerator, was not in the government's tax! I quote: "Finally: Taking the above findings into consideration, we propose re-evaluating the initiative in accordance with the provisions of the legislation in force for concessions/public private partnership as well as respecting the procedure established by this legislation".

3. Prime Minister Edi Rama has approved the granting of funds to the Municipality of Tirana for the expropriation of the land on which the incinerator of Tirana would be built. This decision of the Council of Ministers contradicts the proposal of the concessionary company and the relationship conveyed by the former Minister of the Environment, Mr. Lefter Koka, where it was determined that this cost would be covered by the concessionaire company itself.

Përpos të gjitha shkeljeve ligjore të mësipërme dhe kundërshtive të ministrave kryesorë të kabinetit Rama, ku përfshiheshin ministri i Drejtësisë z. Ylli Manjani, ministrat e Financave z. Shkelqim Cani dhe z. Arben Ahmetaj dhe ministrja e Shtetit për Marrëdhëniet me Parlamentin znj. Ermonela Felaj, me datë 31.08.2017, u lidh kontrata koncensionare Nr.6021 Rep/Nr.2894 Kol., me fituesin e paracaktuar kompaninë “Integrated Energy BV SPV”, me dy pronarë fiktivë apo thënë ndryshe “presta-nome”, fakt ky tashmë i provuar edhe nga Prokuroria e Posaçme për Luftën Kundër Krimit dhe Korrupsionit (SPAK).

I nderuar z. Nahzi, këto fakte flagrante, të cilat janë tashmë publike dhe të bazuara në dokumente të administruara pjesërisht edhe nga Komisioni Hetimor Parlamentar për inceneratorët, por edhe të depozituara në Prokurorinë e Posaçme për Luftën Kundër Krimit të Organizuar dhe Korrupsionit (SPAK), tregojnë se përgjegjësi kryesor për aferën e inceneratorit të Tiranës është vetë Kryeministri Edi Rama.

Përveç Kryeministrit Rama, përgjegjës tjetër kryesor dhe i drejtpërdrejtë për inceneratorin e Tiranës është kryetari i Bashkisë Tiranë, Erion Veliaj, dhe për këtë arsye ish-ministri i Financave dhe Zëvendëskryeministri Arben Ahmetaj, deklaroi në intervistën e tij të fundit, se përgjegjësit kryesorë dhe direktë për inceneratorin e Tiranës janë Edi Rama dhe Erion Veliaj, ky i fundit i konsideruar prej tij edhe si pronar faktik i inceneratorit Tiranë, pasi siç është bërë publike dhe në dosjen hetimore ndaj tij, drejtuesi i SPAK-ut, z. Altin Dumani shprehet se: “ish-ministri i Financave Arben Ahmetaj ka refuzuar dy herë kërkesën e kryetarit të Bashkisë Tiranë Erion Veliaj për dhënien e këtij koncensioni”, duke specifikuar se financimi i këtij projekti mund të bëhej me prokurim të drejtpërdrejtë nga shteti shqiptar, pa pasur nevojë për dhënien me koncension të këtij shërbimi për 30 vite një kompanie private.

Të gjitha këto fakte të mësipërme, të shoqëruara me të gjithë dokumentacionin përkatës zyrtar dhe me mijëra faqe të tjera materiale, komunikime zyrtare dhe private me e-maile apo “WhatsApp”, të dhëna bankare dhe prova të tjera konkrete të përfshirjes së Kryeministrit dhe Kryetarit të Bashkisë Tiranë në këtë aferë, ne i kemi depozituar zyrtarisht në SPAK prej pothuaj 1 viti, por per te amnistuar Kryeministrin Rama dhe kryetarin e Bashkisë Tiranë Veliaj, SPAK këto dokumente flagrante refuzon t’i shohë dhe t’i marrë në konsideratë.

Kryeministri Edi Rama gjithashtu ka firmosur në kundërshtim me ligjin “Për koncensionet dhe partneritetin publik/privat”, për negocimin pa shpallje të kontratës koncesionare për ndërtimin e Inceneratorit të Elbasanit. Rama dhe Këshilli i Ministrave kanë miratuar këtë procedurë, edhe pasi Sekretari i Përgjithshëm i Këshillit të Ministrave z. Engjell Agaci, u njoftua zyrtarisht me shkresën nr.12303/1, Prot., date 18.11.2014, nga Drejtori i Agjencisë së Prokurimeve Publike z. Eduard Ahmeti, se procedura e përzgjedhur për dhënien e këtij koncesioni negocim pa shpallje është e paligjshme, ndaj dhe kjo procedurë nuk mund të përdorej pasi nuk ishte në përputhje me parashikimet ligjore. Citoj: “Sa më sipër APP vlerëson se përcaktimi i Autoritetit Kontraktues dhe procedura përzgjedhëse për objektin konkret duhet të bëhet në përputhje me parashikimet ligjore”.

Gjithashtu Kryeministri Rama sërish në kundërshtim me ligjin, ka firmosur transferimin e fondit të emergjencës të Këshillit të Ministrave në buxhetin e Ministrisë së Mjedisit, për kontraktimin pa garë të Inceneratorit të Elbasanit. Ky fond përdoret vetëm për emergjenca natyrore dhe vetëm me firmë të Kryeministrit.

I nderuar z. Nahzi, Gjej rastin t’ju rikujtoj ju apo kujtdo lexuesi të kësaj letre se përveç fakteve të mësipërme, Kryeministri Edi Rama, siç është vërtetuar nga Gjykata e Washington DC, ka korruptuar dhe ka paguar të paktën 225 mijë dollarë ish-shefin e kundërzbulimit të FBI në New York, z. Charles Mc.Gonigal, gjatë kohës që ka qenë në detyrë. Për këtë arsye ky i fundit është dënuar me 2,4 vite dhe po vuan dënimin në burg në SHBA.

Gjithashtu Kryeministri Edi Rama ka dhënë pa garë 1,4 milionë metër katrorë tokë publike në territorin e Portit të Durrësit dhe vetë portin e Durrësit miliarderit arab z. Mohamed Alabbar për ndërtimin e Dubai City në Durrës, me 12500 apartamente dhe 5-6 hotele me 5 yje, etj.

Kryeministri Edi Rama, në një akt korruptiv me vendim të Këshillit të Ministrave Nr.183, datë 9.3.2016, ka dhënë me 1 euro direkt pa tender, plot 37000 metër katrorë dhe 5160 metër katrorë ndërtesa për vetëm 1 euro, ndërmarrjes private që drejton vëllai i tij Olsi Rama. Kjo tokë sipas ligjeve të vendit nuk mund t’u jepej kompanive private, por duhet t’u kthehej ish-pronarëve legjitimë, familjeve Deliu dhe Liçi.

Një akt tjetër madhor korruptiv i kryeministrit është edhe kostoja e ndërtimit të Tunelit të Llogarasë. Në vitin 2021, pasi u anulua fillimisht herën e parë tenderi, i cili u fitua nga një kompani shqiptare me ofertë 140 milionë euro, u hap për së dyti gara për tenderin e ndërtimit të Tunelit të Llogarasë, ku këtë radhë fitues u shpall një bashkim operatoresh turk me ofertë 190 milionë euro.

Fitues u shpall bashkimi i operatorëve turk fill pas takimit privat në Turqi me Kryeministrin Rama, e ndërkohë tunelin e ndërtoi plotësisht kompania shqiptare si nënkontraktore, me po të njëjtën vlerë që kishte fituar tenderin herën e parë, me vlerën 140 milionë euro.

Recently, Edi Rama and his family have received as an inheritance in the area of ??Himara by court decision, about 224 thousand square meters of land without having any cadastral documents for its ownership, nor documents for its expropriation, which had forced the Agency of Property Handling and the cadastre offices, refused to recognize the Rama clan's ownership of this land in the most touristic area of ??the Albanian coast.

But the SPAK, which in my opinion and numerous positions in the media, is under the influence and influence of Mr. Rama does not investigate any act or corrupt procedure signed by the Prime Minister Edi Rama and the Mayor of Tirana Erion Veliaj, or for which the Prime Minister has given orders or made an open public campaign.
