8000 euros as payment/ SPAK takes lawyer to trial for illegal influence over

SPAK has sent lawyer Besart Logu for trial at the GJKKO.

Logu is accused of illegally influencing prosecutors and judges through payments amounting to up to 8,000 euros. 

Announcement: 

The case was registered on 27.11.2024 for the criminal offenses:

“Passive corruption of judges, prosecutors and other officials of the justice system”, provided for by Article 319/ç of the Criminal Code, and
“Exercising illegal influence over persons exercising public functions”, provided for by Article 245/1 of the Criminal Code.
The proceedings were registered following the complaint of the citizen with the initials, SC and were followed by proactive investigations relying on special investigation methods:

From the evidence collected, it has emerged that the defendant Besart Logu requested and then received, on December 13, 2024, the amount of 8,000 euros, with the aim of influencing the prosecutor, judge and accounting experts who were examining a criminal case against his client, citizen SC, at the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana.

His client was accused of the criminal offenses of "Creating fraudulent schemes related to value added tax", committed in collaboration, "Hiding income" and "Forgery of seals, stamps or forms", committed in collaboration, provided for by articles 144/a and 25, 180/3 and 190/2 of the Criminal Code.

The amount was handed over by the undercover agent and received from the defendant in exchange for the promise to release his arrested client. The results of the investigation prove that the amount of 8,000 euros was not received as payment for legal services provided as a lawyer, but as an irregular benefit, with the aim of illegally influencing justice officials, in exchange for his client's release from prison, a fact that did not occur, based on the investigations conducted.

From the analysis of the evidence, the Special Prosecution Office has concluded that the defendant Besart Logu has fulfilled the elements of the criminal offense, "Exercising illegal influence over persons exercising public functions", provided for by Article 245/1/4 of the Criminal Code.

This criminal offense is formal and its commission does not require the realization of the promised consequence (e.g. release from prison or alleviation of charges), but the seeking or receiving of an improper benefit with this claim is sufficient. /CNA
