Member of a structured criminal group/ GJKKO sentences Fabio Gjoni to prison

The Criminal Court of Kosovo announced today the decision to sentence the defendant Fabion Gjoni to prison.

John is accused of committing the criminal offenses of "Cultivation of narcotic plants", "Production and sale of narcotics", in the form of cooperation with a structured criminal group, "Participation in a structured criminal group".

Due to the summary trial, Fabion Gjoni was sentenced to 6 years and 8 months in prison.

Full announcement:

1. The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject matter: "Trial of the criminal case with the defendant Fabion Gjoni, accused of committing the criminal offenses "Cultivation of narcotic plants", "Production and sale of narcotics", in the form of cooperation in a structured criminal group, "Participation in a structured criminal group", provided for by articles 283/1, 284/1, 28/4, 333/a/2 and 334/1 of the Criminal Code".

2. The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Etleva Deda, Flojera Davidhi and Rudina Palloj, with decision no. 70, dated 11.11.2025, decided:

1. The guilty plea of ??the defendant Fabion Gjoni for committing the criminal offense of "Cultivation of narcotics", committed in the form of a structured criminal group, provided for by articles 284/1, 28/4 and 334/1 of the Criminal Code and his sentence to 8 (eight) years of imprisonment.

2. The guilty plea of ??the defendant Fabion Gjoni for committing the criminal offense of "Production and sale of narcotics", committed in the form of a structured criminal group, provided for by articles 283/1, 28/4 and 334/1 of the Criminal Code and his sentence to 10 (ten) years of imprisonment.

3. The guilty plea of ??the defendant Fabion Gjoni for committing the criminal offense of "Structured criminal group", provided for by Article 333/a/2 of the Criminal Code and his sentence to 2 (two) years of imprisonment.

4. In concurrence of sentences pursuant to Article 55 of the Criminal Code, the sentence of the defendant Fabion Gjoni to 10 (ten) years of imprisonment.

5. Pursuant to Article 406/1 of the Code of Criminal Procedure, the defendant Fabion Gjoni shall have 1/3 (one third) of the sentence imposed reduced, being finally sentenced to 6 (six) years and 8 (eight) months of imprisonment.

6. Based on Article 33 of the Criminal Code and Article 15 of Law No. 81/2020 “On the rights and treatment of prisoners and detainees”, the defendant Fabion Gjoni will serve his sentence in one of the institutions for adult and high-security prisoners.

7. The seized items shall remain part of the court file for the purpose of the criminal proceedings separated with no. 71/1 of 2024. The procedural expenses incurred during the preliminary investigation phase, the preliminary hearing and during the trial, according to the minutes attached to this decision, shall be borne by the defendant.

9. An appeal is allowed against this decision within the legal deadline, to the Special Court of Appeal for Corruption and Organized Crime. /CNA
