Full statement

In defense of the integrity and dignity of the magistrate

The National Association of Judges of the Republic of Albania has followed with attention and deep concern the recent statements and publications in visual, written and electronic media, which have focused on the candidacy of magistrate Mr. Asim Vokshi for the position of judge in the Constitutional Court.

These publications have taken the form of personal attacks, which have exceeded the limits of permissible criticism and have turned into denigrations that directly violate the dignity, reputation and institutional integrity of the magistrate.

The Association values ??the fundamental role that the media plays in a democratic society, as a guarantor of transparency and public accountability. Freedom of expression and dissemination of information, as provided for in Article 10 of the European Convention on Human Rights (ECHR) and Articles 22 and 23 of the Constitution of the Republic of Albania, constitute inalienable foundations of the rule of law. However, the exercise of these freedoms must be done in a responsible, ethical manner and with respect for the truth, so that the media does not become a means of pressure or an instrument for the violation and denigration of the image of magistrates.

The association emphasizes that media freedom cannot be used to justify public pressure, incitement, contempt or violation of the human and institutional dignity of the magistrate, especially in such nomination processes with great importance and impact on the public.

Personal denigration and media attempts to delegitimize the nomination processes of magistrates run counter to professional journalistic standards, the principles of public ethics, and the obligation to respect human dignity stemming from the Constitution, law, and international human rights instruments. Crossing these boundaries constitutes an abuse of guaranteed rights and undermines the public's trust in the justice system, which magistrates strive to earn through their daily work.

The National Association of Judges of the Republic of Albania calls on all representatives of the television, written and electronic media to be guided by the principles of good faith, professional ethics and journalistic deontology in the exercise of their profession. We reiterate that respecting the dignity of magistrates is a fundamental condition for the independent exercise of judicial power and for maintaining and strengthening public confidence in justice.

This public stance should not be interpreted as an attempt to create communication walls or limit cooperation with the media. On the contrary, the Association reiterates its readiness for dialogue and inter-institutional cooperation, in the function of honest and professional communication that reflects the role and responsibility of the judiciary in protecting the rule of law and the principles of democracy./CNA
