The Federation of Opposition Parties has reacted to the dismissal of Fredi Beler as the mayor of Himara and to the setting of the election date.

The Federation of Opposition Parties claims that the CEC and President Bajram Begaj have threatened the constitutional order.

According to her, the government has gone above the law, and therefore must be punished

Statement of the Federation of Opposition Parties:

Yesterday, the ruling party put an end to any illusion that the Constitution of Albania is the fundamental document of the state.

Prime Minister Rama, after taking him hostage, through a hasty and illegal process 14 months ago, after parading him through the courtrooms, yesterday, contrary to the law and the Constitution, removed the mandate from the elected mayor of Himara, Fredi Beleri, and announced the elections for his replacement.

The State Commissioner of Elections, in an emergency session, dismissed Beler. This opened the way for the President of the Republic, with the same urgency, to decree the elections in Himara on August 4.

Edi Rama is already unhindered in his plan for the mayor of Himara to be appointed, not elected.

Only one of his appointees gives him a free hand to extend the government's "strategic investors" even to the still unoccupied coast of Himara.

The speed with which the institutions of the Republic moved, under command, only proves what the opposition parties have been emphasizing for a long time. In Albania there is no separation or balance of powers, only the superpowers of Edi Rama.

Fredi Beleri was paraded once again yesterday, from the prison to the CEC, to remove his mandate, even though for 13 months he was asking for permission to take the same mandate that the citizens of Himara had given him.

The law did not allow him to take it, but to leave it, say Edi Rama's anti-legal lawyers.

Fredi Beleri's hostage today is twofold: as elected by the citizens of Himara and by the citizens of the EU, who gave him the status of MEP.

Yesterday's chain decisions are a legal violation and a dangerous legal and political precedent.

The Commissioner's decision is not even enforceable. Article 133 of the law no. 44/2015 "Code of Administrative Procedures" provides that the effects of the administrative act are suspended until the review of the appeal. 

President Begaj's decree is also unsupported by law. According to Article 10/3 of the Electoral Code, the President announces early elections after the deadline for appealing the dismissed subject has passed. Nor did they give the mayor and MEP Beleri the chance to complain, after they took away his oath and freedom.

The Federation of Opposition Parties considers the constitutional order threatened by such acts.

We call on the institutions to protect not only the law and the Constitution but also their reputation.

This government overstepping the law, and many others like it, must be punished.
