Another abuse of Veliaj and his director / Violations in the company

Journalist Ola Xama has discovered another abuse of the mayor Erion Veliaj and his director Redi Molla.

She has published a document and shows that the mayor Erion Veliaj has decided to appoint Redi Molla as the administrator of Tirana DC, the public company owned by the Municipality, and he is also charged with the duties of a member of the Governing Council and of the legal auditor.

The journalist emphasizes that this is a major conflict of interest.

"Tirana DC was founded on October 28, 2020 as a public enterprise owned by the municipality of Tirana. Its purpose is the construction, reconstruction, development of municipal properties and investment or co-investment with private actors.

The mayor of Tirana decides that the administrator of the company will be Mr. Redi Molla, who is also charged with the duties of a member of the Governing Council and that of a legal auditor. A bigger conflict of interest has never been seen. "Redi Molla gave an account to himself as a member of the Governing Council and checked himself as an external auditor with the task of an accounting expert", says the journalist.

Xama further reveals violations of the law, showing that the law stipulates that public companies must have at least 5 members on the Board of Directors, while Tirana DC has only 3.

It also clarifies that the financing of public companies by the state is unequivocally prohibited, except by special law for special and well-argued situations. In the case of Tirana DC, the decision of the Municipal Council expressly states that "it can be financed by the municipality".

"The appointment as an accounting expert of someone who does not even have a license to practice this profession is illegal, but the actions to change the situation were taken only after the media (ACJQ) and civil society denounced it.

In addition to the pure conflict of interest, the decision to establish this company with the placement of a single employee in management and controlling positions is in open violation of the Law on State Enterprises. The law stipulates that public companies must have at least 5 members on the Board of Directors, Tirana DC has had and continues to have only 3, 1 of them must be a representative of the employee union and the auditors must be independent.

Financing of public companies by the state is strictly prohibited, except by special law for special and well-argued situations. In the case of Tirana DC, the decision of the Municipal Council expressly states that "it can be financed by the municipality", writes the journalist.

Then, until the end of 2022, Tirana DC has collected 0 income and 1.7 million euros of expenses, according to the balance sheets.
