The Prosecutor's Office of Tirana has investigated the Director of Information Technology in the State Police, Ervin Muça, who is accused of illegally exporting the data of the TIMS system.

The prosecution has requested "House arrest" and "Suspension from exercising a duty or public service" for the IT Director.

The investigation showed that, on 02.08.2023, in the database of the State Police, there was entry and export of unauthorized data.

The actions were carried out late at night, where unauthorized persons entered the building with the personal pin of another employee who was not present, raising reasonable suspicions of incorrect actions and in violation of the law.

The prosecution emphasizes that the EM citizen violated the law in another case. It turns out that he is an external advisor to the Director of the State Cadastre Agency, while also working as the Director of the Department for Technology and Information in the State Police.

Exported the TIMS database of the State Police, the Tirana Prosecutor's Office requests 'House arrest' and "Suspension from exercising a duty or public service" for the IT Director

The Prosecutor's Office at the Court of First Instance of the General Jurisdiction in Tirana requests security measure "House arrest" and "Suspension from exercising a duty or public service", provided by articles 237, 242 of the Code of Criminal Procedure for the EM citizen, i suspected of committing the criminal offense provided for by Article 192/b/2 of the Criminal Code "Unauthorized computer access".

The General Directorate of the State Police has referred to the procedural material registered with no. 9866, dated 01.09.2023 for the criminal offense of "Abuse of duty", as well as "Unauthorized Computer Access", provided by articles 248 and 192/b of the Criminal Code. Likewise, with letter no. 2482 prot, date 08.08.2023 The Police Supervision Agency forwarded investigative material, recorded with no. 10898, dated 08.08.2023, for assessment and criminal proceedings no. 5404, dated 01.09.2023.

Following the investigation, the EM citizen was taken as a person under investigation, suspected of committing the criminal offense of "Unauthorized Computer Access", provided for by Article 192/b/2 of the Criminal Code.

In summary, from the investigation of the criminal proceedings, it results that, on 02.08.2023 in the database of the State Police, which is located in the building of the Directorate of Technology and Information at the address Rr. Mine Peza in Tirana, there was entry and export of unauthorized data by the Director of Technology and Information, EM The actions were carried out late at night, where unauthorized persons entered the building with the personal pin of another employee not present, raising reasonable suspicions of incorrect actions and in violation of the law.

The investigation of this criminal proceeding has been extended to the questioning of all the characters involved on the day of the event, but at the same time also to the performance of relevant expertise. Following the investigative process, verifications were carried out on the credibility of the person under EM investigation, in relation to his position as Director of the Department for Technology and Information.

The person under investigation, according to letter no. 3041/1 prot, date 08.01.2024 of the Police Supervision Agency, it results that on 23.10.2007 in Italy he was reported as responsible for the criminal offenses of false documents committed by private persons and the use of a false act. On 09.09.2008, the EM citizen was notified of the decision to refuse the renewal of the residence permit obtained by the police headquarters in Bari.

From the investigation and the criminal proceedings, among others, it results that the person under investigation is an external advisor to the Director of the State Cadastre Agency, while he is also the Director of the Department for Technology and Information in the State Police. The law on the state police prohibits second activities besides teaching. The person under EM investigation did not declare this second activity in the application documents for the DTI position in the state police.
