Connected to criminal groups that trafficked drugs/ SPAK sends three former

The Special Prosecution Office has closed the investigations and sent three former police officers to trial for links to structured criminal groups in the trafficking and cultivation of narcotics.

The three former officers sent for trial are Erdit Hazizaj, Shkëlzen Ruska and Ervis Alisinanaj.

Hazizaj is accused of committing the criminal offenses of "Drug trafficking", "Structured criminal group", "Commitment of criminal offenses by a criminal organization and a structured criminal group" and "Abuse of office".

Ruska is accused of "Cultivation of narcotic plants", "Structured criminal group", "Commitment of criminal offenses by a criminal organization and a structured criminal group" and "Abuse of office".

Meanwhile, Alisinanaj is facing charges of committing the criminal offense of "Abuse of office".

According to SPAK's announcement, the former police officers are suspected of having assisted members of criminal groups involved in the cultivation and trafficking of narcotics by providing them with information. They are accused of not having taken the necessary legal measures to prevent and crack down on criminal activity, favoring its continuation.

The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance the request for the trial of criminal proceedings no. 169/1 of 2022, against the defendants:

Erdit Hazizaj , accused of committing criminal offenses:

"Drug trafficking", carried out in a special form of cooperation, that of a structured criminal group, provided for by articles 283/a, first paragraph, and 28/4 of the Criminal Code;

“Structured criminal group”, committed in the form of participation in a structured criminal group, provided for by Article 333/a, second paragraph, of the Criminal Code;

“Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by Article 334, point 1 of the Criminal Code;

"Abuse of office", provided for by Article 248 of the Criminal Code.

Shkëlzen Ruska , accused of the following criminal offenses:

"Cultivation of narcotic plants", carried out in a special form of cooperation, that of a structured criminal group, provided for by articles 284, first paragraph, and 28/4 of the Criminal Code;

“Structured criminal group”, committed in the form of participation in a structured criminal group, provided for by Article 333/a, second paragraph, of the Criminal Code;

“Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by Article 334, point 1 of the Criminal Code;

"Abuse of office", provided for by Article 248 of the Criminal Code.

Defendant Ervis Alisinanaj, accused of committing the criminal offense:

"Abuse of office", provided for by Article 248 of the Criminal Code.

Ky proçedim penal është ndarë nga çështja penale nr.169 e vitit 2022.

Nga hetimet e kryera rezulton se gjatë viteve 2019-2021, në zonën e Sarandës ka vepruar një grup i strukturuar kriminal i përfshirë në kultivimin dhe trafikimin e bimëve narkotike. Drejtuesi dhe organizatorët e këtij grupi dyshohet se janë shtetasit nën hetim, K.Q (alias J.H, alias J.Q) dhe E.A (alias K.A), Anëtarët e këtij grupi kishin detyra të përcaktuara për sigurimin, transportin dhe trafikimin e lëndëve narkotike nga Shqipëria drejt Greqisë.

Hetimet kanë dokumentuar rastin e trafikimit, më 7.3.2020 përmes pikës së kalimit kufitar në Qafë Botë, të një sasie prej 1144.9 kg cannabis sativa të papërpunuar, 4.068 kg cannabis të përpunuar (çokollatë) dhe 0.916 kg cannabis i përpunuar (vaj), me vlerë rreth 1.700.000 euro. Kjo sasi u është sekuestruar dy shtetasve italianë të dënuar në Greqi.

Kur anëtarë të grupit arrestoheshin nga agjencitë e zbatimit të ligjit, anëtarët e tjerë interesoheshin për ndihmën ekonomike të personave të arrestuar dhe sigurimin e mbrojtjes në proceset gjyqësore. Sipas hetimeve, anëtarët e këtij grupi të strukturuar kriminal kishin krijuar kontakte dhe lidhje shoqërore me punonjës të Policisë së Shtetit, për të bërë të mundur vijimësinë e aktivitetit kriminal.

I tillë është rasti i Erdit Hazizaj, në atë kohë mbante detyrën e specialistit në Sektorin e Hetimit në Mbulim, në Drejtorinë e Forcës së Posaçme Operacionale, i cili i ndihmonte drejtuesit e grupit të strukturuar kriminal me këshilla dhe informacione të vazhdueshme për zhvillimin e aktivitetit të kundraligjshëm.

Gjatë viteve 2019-2021, në zonën Tepelenë-Gjirokastër, ka vepruar një grup i strukturuar kriminal, i përfshirë në kultivimin e bimëve narkotike, nën drejtimin e shtetasit nën hetim, L.B (alias E.S), ndërsa pjesëtarët e grupit kishin detyra të ndara për kultivimin e bimës narkotike në zonën Tepelenë – Gjirokastër. Hetimet kanë dokumentuar rastin e datës 1.10.2020, në rrugën mes fshatit Dukaj dhe fshatit Salari (Tepelenë), ku Drejtoria Vendore e Policisë Gjirokastër zbuloi dhe sekuestroi 1360 bimë narkotike, me gjatësi 30-120 cm, në gjendje të njomë, me peshë totale 1280 kg. Sasia e bimëve narkotike ishte kultivuar nga ky grup kriminal.

Drejtuesi i tij kishte krijuar kontakte dhe lidhje shoqërore edhe me punonjës në Policinë e Shtetit, në rastin konkret, me të pandehurin Shkëlzen Ruska, i cili asokohe mbante detyrën e specialistit në Drejtorinë Vendore të Policisë Gjirokastër. Ai dyshohet se ka ndihmuar drejtuesin e grupit të strukturuar kriminal duke ofruar informacione dhe garanci për aktivitetin e kundraligjshëm.

From the totality of the evidence administered, it results that the defendants, Erdit Hazizaj, Shkëlzen Ruska and Ervis Alisinaj, continuously, during 2020, in violation of legal and functional obligations, as employees of the State Police, have committed actions and omissions that have seriously violated the regular functioning of police structures, by failing to take measures to prevent and crack down on criminal activities in the cultivation and trafficking of narcotics or other illegal actions.

These actions, based on the investigations conducted, have brought serious consequences for the legitimate interests of the state and have undermined the credibility of the State Police before the public and have harmed the exercise of its mission in guaranteeing public order and security, in accordance with the Constitution and the law. /CNA
