Violation of equality in tenders/ SPAK sends the former mayor of Memaliaj for

SPAK has sent the former mayor of Memaliaj, Gjolek Guci, for trial.

He is facing charges of violating equality in tenders.

Two other former officials of the Memaliaj Municipality have also been sent for trial. 

Specifically, former vice-mayor Edmonda Harizi and the former director of Public Services, both accused of the same offense as former mayor Guci.

The investigations are related to the 2021 tender for the construction of a regional water supply system in several villages of Memaliaj.

The investigations revealed that the mayor of Memaliaj, who was also the head of the contracting authority, in collaboration with members of the KVO, created unfair advantages and privileges for third-party operators.

The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance the request for the trial of criminal proceedings no. 216/1 of 2024, against the defendants:

Gjolek Guci, former Mayor of Memaliaj Municipality, accused of the criminal offense "Violation of equality of participants in tenders or public auctions", committed in collaboration, provided for by articles 258 and 25 of the Criminal Code (before amendments by law no. 43/2021, dated 23.03.2021);
Edmonda Harizi, former Deputy Mayor of Memaliaj Municipality, accused of the same criminal offense;
Feta Hoxha, former Director of Public Services at Memaliaj Municipality, accused of the same criminal offense;
Bersant Ylli, administrator of the entity "Bersant Ylli", accused of the same criminal offense.
The investigations have been initiated on the basis of the criminal report sent by the Supreme State Audit on 28.10.2024. For this purpose, on 04.11.2024, criminal proceedings were registered for the criminal offense "Violation of equality of participants in tenders or public auctions".
The object of the investigation was the procurement procedure "Construction of the Regional Water Supply for the villages of Vasjar, Iliras, Qesarat, Anë-Vjosë, Toç, Lulëzim, Zhulaj, Krahës and the city of Memaliaj", of 2021, with the contracting authority Memaliaj Municipality.

The investigations have revealed that the Mayor of Memaliaj Municipality, citizen Gjolek Guci, on September 21, 2020, signed the donation contract with no. 658/1 Prot., with the economic operator "Artreum Generation" sh.pk, represented by the administrator A.Sh. While the project for the implementation of the construction of the regional water supply was approved by the Mayor of Memaliaj Municipality.

The fund for the facility, worth over 493 million lekë (493,183,572), was divided into items for construction, assembly, management and commissioning of the works. The approved value was the same as the cost value of the project donated by the company “Artreum Generation”, a subcontractor of one of the winning companies of the tender.

After analyzing the procurement procedure documentation, it was found that the members of the Bid Evaluation Commission, citizens Edmonda Harizi, Feta Hoxha, Bersant Ylli and the head of the contracting authority (Memaliaj Municipality), citizen Gjolek Guci, in collaboration with each other, have created unfair advantages and privileges for third-party operators, by qualifying and declaring the winner the joint venture of economic operators "KEG" sh.pk & "ED Konstruksion" sh.pk, which had deficiencies in the submitted documentation, especially in the criteria for technical capacity.

Also, subcontracting was accepted with the economic operator "Artreum Generation" sh.pk, which was in a conflict of interest, as it had donated the project and drafted the technical specifications and did not meet the legal criteria for a subcontractor.

On 28.01.2026, it was decided to divide criminal proceedings no. 216 into criminal proceedings 216/1, for further investigations regarding the implementation of the contract, for which further investigative actions are required.
