The government approved on Wednesday of this week the procedures to be followed for the registration of copyrights under the 2016 law "On copyrights and other related rights", underlining that everything goes through e- Albania. The decision clarifies step by step all the links that must be completed until registration.

Thus copyright registration is voluntary and refers only to copyright. This registration is carried out by the Copyright Directorate in the ministry responsible for copyright.

"The application for copyright registration is carried out online on the "e-Albania" portal, in the "Copyright Registration" electronic service. The application is made by the author of the work, the legal heir, the representative authorized by the author/co-author or the collective administration agency. The application for copyright registration is accompanied by the necessary documentation, as follows: Payment order, which is valid only for one application, through which a certain number of works are registered, according to the fees provided in annex 1, which is attached to this decision and is an integral part of it;

b) Copy of the work online on the "e-Albania" portal or physically, in written form or CD, in the protocol of the ministry responsible for copyright;

c) The document authorizing the representation, in case the request is made by a representative;

ç) The document of proof of inheritance, in case the request is made by the legal heir/s," the decision states.

The latter determines that the maximum term for registration is 30 days, during which there are a number of points that are included such as:

a) application and filing of accompanying documents on the "e-Albania" portal. Exceptionally, only the documents, which cannot be uploaded in electronic format, are sent to the institution in hard copy format within 5 (five) days from the date of application;

b) correction of inaccuracies by the applicant, within 5 (five) days from the request of the Copyright Directorate, in cases where the application has not been submitted, in accordance with point 6 of this decision. In case of failure to fill in the inaccuracies within this deadline, the application is rejected;

c) consideration of the request in relation to the provisions of the copyright law within 15 (fifteen) days. In case the work that is requested to be registered is not the object of copyright protection, the application is rejected in a reasoned manner;

ç) registration of the work and provision of a certificate or refusal, according to letter "c" of this point, within 5 (five) days.

If the legal conditions for copyright registration are met, the Copyright Directorate issues the copyright registration certificate. The copyright registration certificate is obtained through "e-Albania" with an electronic signature or seal. /Monitor
