The Prosecutor's Office at the Court of First Instance of Durrës General Jurisdiction has registered criminal proceedings no. 22 of 2021 against citizens MI, MK, HH, AM, DZ, M. Sh., JK, GK and MT, suspected of committing of the criminal offenses "Abuse of duty carried out in collaboration" and "Criminal failure" provided by articles 248 and 25 and 300 of the Penal Code.

From the investigations it was found that in 2013, employees of the former Aluizni Durrës have legalized several properties located in Xhafzotaj municipality, parts of which are built on the property which has an area of ??2184 m2 and is categorized under the cadastral item "Road" with legal status "state".

Also, employees of IMT Shijak, with their inaction, have consumed elements of the criminal offense of "Misuse of duty carried out in cooperation" provided by article 248 and 25 of the Penal Code, as they have taken demolition decisions which have not been executed and they have not filed criminal charges in relation to the illegal constructions they found.

The AK citizen with the duty of the Director of the board of the sewage company, has consumed the elements of the criminal offense of "Abuse of duty" as with the letter no. 158/1 dated 26.03.2015, he replied to the Directorate of Aluizi Durrës, where he informed that the object of the citizen FH, does not affect the objects, the drainage system that the Durrës-Kruje Drainage Board has in its inventory.

For the above, within the framework of the investigations of the above-mentioned proceedings, the prosecution requested the Court of First Instance with General Jurisdiction in Durrës, the appointment of security measures against the 9 citizens under investigation as follows.

• "Suspension of exercising a duty or public service" and "Prohibition of exiting the country" provided respectively by articles 242 and 233 of the Criminal Code against the MI citizen, accused of committing the criminal offense provided by article 248 25 of the Penal Code.

• "Suspension of the exercise of a duty or public service" provided by article 242 of the Criminal Code against the citizen M. K, suspected of committing the criminal offense provided for by article 248 and 25 of the Criminal Code.

• "Suspension of the exercise of a duty or public service" and "Prohibition of exiting the country" provided respectively by articles 242 and 233 of the Criminal Code against the citizen HH suspected of committing the criminal offense provided for by article 248 e 25 of the Penal Code.

• "Suspension of the exercise of a duty or public service" and "Prohibition of exiting the country" provided respectively by articles 242 and 233 of the Penal Code against the AM citizen, suspected of committing the criminal offense provided for by article 248 25 of the Penal Code.

• "Suspension of the exercise of a duty or public service" and "Prohibition of exiting the country" provided respectively by articles 242 and 233 of the Criminal Code against the citizen DZ, suspected of committing the criminal offense provided for by article 248 25 of the Penal Code.

• "Suspension of the exercise of a duty or public service" provided by article 242 of the Criminal Code against the citizen M.Sh, suspected of committing the criminal offense provided for by articles 248 and 25 and 300 of the Criminal Code.

•      “Pezullimi i ushtrimit të një detyre a shërbimi publik” dhe “Ndalimi i daljes jashtë shtetit”, të parashikuar përkatësisht nga nenet 242 dhe 233 të K.Pr.Penale ndaj shtetasit J.K, i padenuar më parë, i dyshuar për kryerjen e veprës penale të parashikuar nga neni 248 e 25 dhe 300 të K.Penal.

•      “Pezullimi i ushtrimit të një detyre a shërbimi publik” dhe “Ndalimi i daljes jashtë shtetit” të parashikuar përkatësisht nga nenet 242 dhe 233 të  K.Pr.Penale ndaj shtetasit G. K, i dyshuar për kryerjen e veprës penale të parashikuar nga neni 248 e 25 të K.Penal.

•      “Pezullimi i ushtrimit të një detyre a shërbimi publik” dhe “Ndalimi i daljes jashtë shtetit” të parashikuar përkatësisht nga nenet 242 dhe 233 të  K.Pr.Penale ndaj shtetases M.T, e dyshuar për kryerjen e veprës penale të parashikuar nga neni 248 e 25 dhe 300 të K.Penal.

With the decision dated 24.05.2023, the Court of First Instance of the General Jurisdiction of Durrës decided to confirm the coercive measure "Suspension of the exercise of a duty or public service" provided by Article 242 of the Penal Code, against citizens HH DZ M .SH and GK To revoke the measure "Suspension of the exercise of a duty or public service" provided by article 242 of the Penal Code, against the citizens of MK, MI, JK and to declare inadmissible the requests for the citizens of AM and MT
