Judges' salaries/ Constitutional Court makes decision

The Constitutional Court has announced its decision regarding the lawsuit of judges seeking a salary increase.

The court partially accepted the judges' request.

The Constitutional Court says that judges' salaries cannot be reduced.

In the aforementioned decision, the Constitutional Court requests legal changes from the Assembly. 

 

Constitutional Court decision:

 

At the conclusion of the examination of this case, for the above reasons, the Court, by majority vote, decided:

1. Partial acceptance of the request.

2. Repeal of the first sentence of letter “a” of Article 1, as well as point 2 of Article 2 of Law No. 33/2023, dated 25.05.2023 “On an amendment to Law No. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, as incompatible with the Constitution of the Republic of Albania.

3. Obligation of the Assembly to approve the necessary legal amendments, according to the reasoning of this decision, by 31.07.2026.

4. The effects of the above repeal shall enter into force on the day the legal amendments enter into force and, in any case, no later than 31.07.2026.

5. This decision is final and enters into force on the day of publication in the Official Gazette.

The final decision will be announced with reasons within the legal deadlines provided for by Law No. 8577, dated 10.02.2000 “On the Organization and Functioning of the Constitutional Court of the Republic of Albania”, as amended by the Regulation on Judicial Procedures of the Constitutional Court.
