Illegal influence on judicial officials/ GJKKO finds 3 people guilty

The Special Court against Corruption and Organized Crime has found three people guilty of the criminal offense of exercising unlawful influence over persons exercising public functions in the field of justice.

Musa Gjikola, Erjon Dani and Vilson Roçi were sent for trial by SPAK on October 28, 2025 and were tried by the GJKKO in a summary procedure.

Announcement:

1. The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject: “Trial of the criminal case with no. 177/1 of the 2025 proceedings, against the defendants Musa Gjikola, Erjon Dani and Vilson Roçi”.

2. The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Rudina Palloj, Atalanta Zeqiraj and Flojera Davidhi, with decision no. 9, dated 05.02.2026, decided: 1. The guilty plea of ??the defendant Musa Gjikola for committing the criminal offense of “Exercising unlawful influence over persons exercising public functions”, in collaboration (for episode 1), provided for by article 245/1, pg. 1 and 25 of the Criminal Code (according to the wording of the provision before amendments by law no. 43/2021) and his sentence to 1 (one) year and 6 (six) months of imprisonment. 2. In application of Article 406/1 of the Code of Criminal Procedure, the defendant Musa Gjikola's sentence is reduced by 1/3 (one third), being finally sentenced to 1 (one) year of imprisonment.

3. The calculation of the sentence for the defendant Musa Gjikola begins from the moment of his arrest on 11.07.2025, and the sentence of imprisonment will be served in a regular security prison.

4. The guilty plea of ??the defendant Erjon Dani for committing the criminal offense of "Exercising unlawful influence over persons exercising public functions", (for episode 1), provided for by article 245/1, pg. 2 of the Criminal Code (according to the wording of the provision before amendments by law no. 43/2021) and his sentence to 2 (two) years of imprisonment.

5. The guilty plea of ??the defendant Erjon Dani for committing the criminal offense of "Exercising unlawful influence over persons exercising public functions", (for episode 2), provided for by article 245/1, pg. 2 of the Criminal Code (according to the wording of the provision before amendments by law no. 43/2021) and his sentence to 2 (two) years of imprisonment.

6. The acquittal of the defendant Erjon Dani, accused of committing the criminal offense of "Abuse of office", provided for by Article 248 of the Criminal Code, as referred to in Article 388, point 1, letter b) of the Code of Criminal Procedure, since the fact subject to the accusation does not constitute a criminal offense.

7. Pursuant to Article 55 of the Criminal Code, in conjunction with the sentences, the defendant Erjon Dani is sentenced to a single sentence of 3 (three) years of imprisonment.

8. In application of Article 406/1 of the Code of Criminal Procedure, the defendant Erjon Dani's sentence is reduced by 1/3 (one third), being finally sentenced to 2 (two) years of imprisonment.

9. The calculation of the sentence for the defendant Erjon Dani begins from the moment of his arrest on 11.07.2025 and the prison sentence will be served in a regular security prison.

10. The guilty plea of ??the defendant Vilson Roçi for committing the criminal offense of "Exercising unlawful influence over persons exercising public functions", in collaboration (for episode 2), provided for by article 245/1, pp. 1 and 25 of the Criminal Code (according to the wording of the provision before amendments by law no. 43/2021) and his sentence to 1 (one) year and 6 (six) months of imprisonment.

11. The guilty plea of ??the defendant Vilson Roçi for committing the criminal offense of "Exercising unlawful influence over persons exercising public functions", in collaboration (for episode 3), provided for by article 245/1, pp. 1 and 25 of the Criminal Code (according to the wording of the provision before amendments by law no. 43/2021) and his sentence to 1 (one) year and 6 (six) months of imprisonment.

12. Pursuant to Article 55 of the Criminal Code, in conjunction with the sentences, the defendant Vilson Roçi is sentenced to a single sentence of 1 (one) year and 6 (six) months of imprisonment.

13. In application of Article 406/1 of the Code of Criminal Procedure, the defendant Vilson Roçi's sentence is reduced by 1/3 (one third), being finally sentenced to 1 (one) year of imprisonment.

14. The calculation of the sentence for the defendant Vilson Roçi begins from the moment of his arrest on 11.07.2025, and the sentence of imprisonment will be served in a regular security prison.

15. The procedural costs incurred during the preliminary investigations, according to the minutes for recording the investigation costs, and the judicial costs, according to the respective minutes for recording the judicial costs, in reference to Articles 393/1 and 285/1 of the Code of Criminal Procedure, are charged to the defendants who plead guilty with this decision, jointly and severally.

16. The Special Prosecution Office against Corruption and Organized Crime is charged with the implementation of this decision. 17. An appeal may be filed against this decision at the Court of Appeal against Corruption and Organized Crime, within 15 (fifteen) days, starting from the day after the notification of the reasoned decision. /CNA
