Who has filled the prisons to capacity: the Prosecutor's Offices and District Courts or the SPAK and GJKKO?

CNA was able to obtain official figures on the total number of people serving sentences or being imprisoned in Albania. According to official data, the number of convicted persons is around 1,700 in Albanian prisons and 2,744 are in pre-trial detention.

According to the data, only 3.35% belong to SPAK, so only 3.35% of the 2744 people held in detention are the figures of people held in cells at the request of the Special Prosecution Office and by decisions of the GJKKO.

Meanwhile, the media is spouting nonsense: "SPAK is imprisoning people", "Unfair detention..."

In fact, SPAK has the lowest number of people in detention, who come from criminal offenses of organized crime and corruption. The Prosecutor's Office of General Jurisdiction has the largest number of detainees in the country, after referrals made by the State Police, including those people who burn garbage and burn their fields, people who build arson, roofs and other criminal offenses, which are not under the competence of SPAK.

Prisons are full due to requests coming from the Prosecutor's Office of General Jurisdiction and from decisions of district courts.

The numbers speak for themselves and this trend has continued for years, although today we have the lowest figure in 10 years. If SPAK were as aggressive with detentions as the prosecutors of general jurisdiction are, they would have filled the prisons to capacity for minor criminal offenses, after appeals and continuous requests from the government and the Prime Minister, starting in 2014-2015 with the issue of illegal energy, unauthorized construction, cutting down trees or even burning grass.

It is the General Jurisdiction Prosecutor's Office that has filled the prisons with detainees. And the comparative percentage figure, including the 2025 amnesty, of detainees in cells is actually the lowest in the last 10 years.

But this figure, which some see as worrying, comes due to requests from district prosecutors regarding certain issues and decisions by district courts.

SPAK has the lowest number, only 3.35%. This refers to the crimes that are part of the investigations conducted by SPAK, mainly organized crime and corruption. All detainees in the figures given are due to the General Prosecutor's Office, the Prosecutor's Office of General Jurisdiction and appeals coming from the political power, from the executive.

Prosecutors respond to the executive's demands with their own demands and judges who detain people for very minor criminal offenses. This is a fact.

Who keeps people in prison: SPAK or the Prosecutor's Office of General Jurisdiction?

The prisons are full of detainees from the Prosecutor's Office of General Jurisdiction and not from SPAK.

Propaganda has already begun to bill SPAK with the figure that another justice institution is responsible for, with a single goal: in the end, to ease detention or to prevent corrupt senior officials from being detained, while thousands of citizens remain in prison because that is the end for them. For those who commit corruption and are senior officials, they "should not" be arrested.

That is why Sokol Sadushi's offensive has begun, with the support of the head of the General Prosecutor's Office, Mr. Çela, who does nothing else but simply seek to transfer the responsibility of the General Jurisdiction Prosecutor's Offices and district courts to SPAK and GJKKO./ CNA
