The Supreme Court has overturned the appeal of the former Prime Minister Sali Berisha, who requested from this court, the lifting of the prohibition to participate in the parliamentary sessions, while he is under house arrest with the decision of GJKKO, from December 30, 2023, regarding SPAK's investigation into the privatization of the former Partizani club.

Also, Jamarbër Malltez's appeal against the house arrest measure, decided by the Special Appeal on November 21 last year, was not accepted by the same Court.

Berisha and Malltezi have opposed the measures as they are considered political and influenced by Prime Minister Rama. Initially, measures of "compulsion to appear" and a ban on leaving the country were requested against Berisha, but they were not respected, with the claim that SPAK had not received permission from the Assembly.

Then it was SPAK that requested permission from the Assembly, but by strengthening the security measure by having to submit to "house arrest". With the security measure of house arrest, Berisha was forbidden to participate in the plenary sessions, which could lead to the loss of the deputy's mandate, since he has been absent from the work of the Parliament for almost 6 months. Berisha's lawyers have stated that the imposition of mass arrest is precisely aimed at burning the deputy's mandate.
