The Constitutional Court overruled the request of the Democratic Party, for the repeal of the law on the administration of the Butrint National Park, leaving in force the agreement for the management of the Butrint National Park by the Albanian American Fund for Development. 

The constitutionalist pointed out that this agreement does not affect national identity or cultural heritage. 

The court assessed that despite the transfer of administrative powers to the Foundation for the Management of Butrint, the state continues to maintain its sovereign attributes, as long as it maintains ownership of this property and indirect administration, in accordance with constitutional standards and principles.

According to the court, despite the fact that the management of Butrint will be carried out by the Albanian American Fund for Development, the role of the state remains primary in relation to Butrint National Park.

But the Constitutional Court assesses that the agreement, in its entirety, has created guarantee mechanisms.

Two years ago, the Albanian government decided that the management of the Butrint National Park will be carried out by a foundation created by the Ministry of Culture and AADF, for a 10-year term, with the right of renewal.

The law was approved by the Assembly in May 2022 and caused protests and heated debates from civil society and opposition MPs, who suspect illegal and unconstitutional exploitation of a large asset of the country, which can be damaged by management through this form.

A group of 36 deputies asked the Constitutional Court to annul as unconstitutional the law on the administration of Butrint National Park./ CNA
