SPAK disclosed details from the first file about the Tirana incinerator, for which 12 people were charged.

Specifically, Lefter Koka, Pëllumb Abeshi, Erjon Murataj, Bledar Karoli, Taulant Tusha, Namik Simixhiu, Etleva Kondi, Alba Thoma, Valbona Ballgjini, Sidita Kopliku, Jetmir Llapaj, Silena Tola have been charged.

These people have favored the company "Integrated Energy BV" to win the concession in Tirana.

SPAK declares that "Integrated Energy BV" was aware of the competitive circumstances before the procedure was announced.

The concessionaire company, behind which the Special Prosecutor's Office has stated that Klodian Zoto and Mirel Mërtiri were hiding, was assisted by the officials of the Ministry of Environment, as well as by the members of the concession granting commission.

It has been equipped with the necessary documentation that it had to submit to the Ministry of Environment before and during the concession procedure, in order to declare this company the winner.

Even for the standard documents of the concession, the notice states that they were not drawn up by the members of the commission, who did not hold meetings or minutes on this matter.

According to SPAK, the documents were drawn up by Klodian Zoto, who then sent them to the employees of the Ministry of Environment, Alba Thoma and Bledar Karoli.

These last two have served as a "connecting bridge" with Klodian Zoto, while former minister Lefter Koka has approved the procedure, without accompanying documentation of the drafting of Standard Concession Documents by the Commission.

Excerpts from SPAK's announcement:

In relation to the procedure for granting the concession with the object: "Construction of landfill, incinerator and rehabilitation of the site of waste disposal in Tirana and the production of electricity", it results that the proposing company "Integrated Energy BV" (in whose composition the company of citizens Klodian Zoto, "Integrated Technology Services" sh.pk) was aware of the competitive circumstances before the procedure was announced. This happened thanks to the help given by the officials of the Ministry of Environment, Lefter Koka, former Minister of Environment, Alba Thoma, Director of the Legal Department, Bledar Karoli, Head of the Procurement Sector, as well as by the members of the awarding committee of the concession, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, where the proposing company "Integrated Energy BV" was provided with the necessary documentation that it had to submit to the Ministry of Environment before and during the procedure concessionaire, in order to declare this company the winner.

Regarding the drafting and approval of standard concession documents , the members of the concession awarding commission, Valbona Ballgjini, Pëllumb Abeshi, Erjon Murataj, Sidita Kopliku, Etleva Kondi, Taulant Tusha, Namik Simixhiu, in cooperation with the head of the Contracting Authority, Lefter Koka, former Minister of the Environment, have acted in violation of law no. 125/2013, "On concessions and public private partnership", amended, as well as VKM no. 575, dated 10.07.2013, "On the approval of the rules for evaluation and concession award, public private partnership", amended.  The Concession Standard Documents do not turn out to have been drawn up and approved by the members of the commission, at the time these documents were uploaded to the Electronic Procurement System, as it turns out that the committee did not hold a meeting or minutes for the drafting of the Concession Standard Documents. 

It turns out that the Standard Documents of the Concession Procedure were drawn up by the employees of citizen Klodian Zoto, owner of the company "Integrated Technology Services" sh.pk, participating in this concession procedure as a shareholder of the Dutch company "Integrated Energy BV", who sent you then the employees of the Ministry of Environment, defendants Alba Thoma and Bledar Karoli. At this time, these two citizens have served as a "bridge" between the Contracting Authority, the Ministry of the Environment and the society of the citizen Klodian Zoto. On the part of the holder of the Contracting Authority, the former Minister of the Environment, Lefter Koka, the continuation of the concession granting procedure has been approved, without accompanying documentation of the drafting of the Standard Concession Documents by the Commission./ CNA
