Accused of drug trafficking and participation in a criminal group/ GJKKO issues

The Special Court has sentenced Ervis Civilon, accused by SPAK of narcotics trafficking, structured criminal group and participation in a criminal organization, to 2 years in prison.

The trial was conducted in a shortened procedure, and the panel consisted of judges Elsa Ulliri, Flojera Davidhi and Bib Ndreca.

Decision of the Criminal Court

"The Special Prosecutor's Office against Corruption and Organized Crime has submitted to the Court the request with the subject matter: "Trial of the criminal case against the defendant Ervis Cvilo, accused of committing the criminal offenses "Drug trafficking", in collaboration, in the special form of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a criminal organization and a structured criminal group", provided for by Articles 283/a/1, 28/4, 333/a/2 and 334/1 of the Criminal Code". 2. The trial of this case was conducted under the rules of summary trial.

At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Elsa Ulliri, Flojera Davidhi and Bib Ndreca, with decision no. 67, dated 28.10.2025, decided:

1. Dismissal of the charge against the defendant Ervis Cvilo for the criminal offense "Drug trafficking", committed in collaboration, in the special form, that of a structured criminal group, provided for by Article 283/a, first paragraph, 28 point 4 and 334 point 1 of the Criminal Code because, based on Article 387 point 1 and 328 point 1, letter "e" of the Criminal Procedure Code, the criminal prosecution should not continue since the defendant Ervis Cvilo has been tried for the same criminal act by a final decision. 2.

The guilty plea of ??the defendant Ervis Cvilo for committing the criminal offense "Structured criminal group", provided for by Article 333/a, second paragraph, of the Criminal Code, and his sentence to 3 years of imprisonment.

3. Pursuant to Article 406, point 1 of the Code of Criminal Procedure, the defendant Ervis Cvilo is reduced by 1/3 (one third) of the sentence given, being ultimately sentenced to 2 years of imprisonment.

4. The sentence shall begin to be served from the moment of arrest and shall be served in a high-security prison.

5. Procedural costs in the preliminary investigation phase as well as court costs are borne by the defendant jointly and severally with the other defendants in related proceedings.

6. An appeal against this decision is allowed to the Special Court of Appeal for Corruption and Organized Crime, within 15 days, starting from the day after the communication of the reasoned decision./ CNA
