Veliaj and his "Process": Literary justifications in the face of

Erion Veliaj, self-proclaimed as the greatest victim of Albanian justice since the dictatorship trials, has embraced the spirit of Franz Kafka's "The Trial" to explain his personal drama. Isolated in detention since February 10, the former mayor of Tirana has foxily entered the role of a literary character, suffering amidst the absurdity of the society he lives in, but on the other hand selects paragraphs, sentences and details from the investigative file, which he takes out of context to blame justice with questions like: "It's good that I am guilty without guilt and without facts, but why the punishment without a trial??".

In his literary alibi, which follows all his Facebook statuses like a thread, Veliaj recalls that before he was arrested he traveled twice to the United States of America, on December 30 and January 20. “I came back again,” he says, surprised. “Where is the danger? Where is the escape?”

Therefore, what he considers to be the risk of flight , Veliaj simplifies with the words: "Judge Bani reasons that since Ols Dado accuses me of crimes punishable by 12 and 15 years - that is, 27 years in prison - I would flee Albania."

Veliaj's goal is to appear as an individual not only innocent, but also powerless in the face of an unjust mechanism, personified by the name of prosecutor Ols Dado, the man who is keeping him in prison without right, perhaps for the remnants of a once-rejected building permit and who has transformed the naive and good mayor of Tirana into a political prisoner.

In fact, the file initialed by Altin Dumani and Olsi Dado and then the decision signed by Judge Erjon Bani describes a completely different character from Franz Kafka's haunted citizens.

In the file, Veliaj emerges as a corrupt mayor who hands out building permits with one hand, while extending the other hand to the offices of his wife, Ajol Xoxa, and accepts villas and cash as bribes, which he circulates to launder with his close friends.

The file contains facts and episodes that Veliaj does not mention, but that no other politician under investigation by SPAK has had the courage to do before. It is these fakes and episodes that have convinced Judge Erjon Bani to sign the mayor's security measure with prison, so that the trial process will be fairer and more impartial.

In addition to Olympic-scale corruption and money laundering, the mayor of Tirana has crossed the boundaries of the absurd by threatening BKH agents through phone messages.

Prandaj dosja prej 360 faqesh shkon përtej gjysëm të vërtetave që përshkruhen në mesazhet e Veliajt në rrjetet sociale.

Përveç akuzave për korrupsion dhe pastrim parash, SPAK ka argumentuar qartë se Veliaj nuk ka ngurruar të përdorë çdo mjet për të frikësuar hetuesit dhe për të manipuluar procesin. Dhe këtu hyn lista e “haramit” që kryebashkiaku nuk e përmend në statuset e tij patetike:

1? Kërcënimet ndaj agjentëve të BKH-së – Po, po, Veliaj nuk ka pritur t’i çojë dikush tjetër mesazhe në emër të tij, por ka marrë vetë telefonin duke u përpjekur të ushtrojë presion mbi hetuesit. Një strategji që e futi edhe më thellë në batakun penal ku gjendet tani.

“Sjellja e shtetasit nën hetim Erion Veliaj, kur bëhet fjalë për komunikimin e përdorur me hetuesit e BKH-së dhe “kurajon” e shfaqur nga ky shtetas për t’i lënë të shkruara mesazhet e tij intimiduese në adresë të organit procedues, dëshmon qartë për personalitetin e këtij të fundit” shkruhet në dosjen që e izoloi në burg.
2? Përdorimi i pushtetit politik në bashki – Marrja në pyetje e Ajola Xoxës, bashkëshortes së Veliajt, ishte një tjetër episod tragjikomik ku del në pah pushteti i tij si kryetar bashkie. Bashkë me Ajola Xoxën, në SPAK kanë qenë edhe punonjës të Bashkisë së Tiranës – një tjetër “detaj” që Veliaj nuk e përmend, por që tregon qartë se si e përdor administratën bashkiake si mburojë personale.

Dhe në arsyetimin e tij, gjykatësi Erjon Bani e përmend këtë si faktor rreziku për “helmimin” e provave, kur thotë:

“Prania e punonjësve të rëndësishëm të Bashkisë Tiranë, vartës të drejtpërdrejtë të shtetasit Erjon Veliaj, si gjatë kontakteve që shtetësja Ajola Xoxa ka patur me personat e thurrr për të dhënë deklarime në prokurorinë e posaçme, ashtu edhe gjatë momenteve të kontrollit në zyrat e Partners Laë shpk, dëshmon synimin për të vënë në rrezik marrjen e provave, por nga ana tjetër edhe miksimin e funksionve publike me ato private të titullarit të bashkisë, duke i kërkuar personave që varen prej tij të kenë kontakte të paautorizuara me hetues në kryerje e sipër të detyrës”

Judge Erjon Bani does not see Ajola Xoxa's action as an isolated episode, but sees it as part of the uncooperative behavior of the Veliaj-Xoxa couple, who both made attempts to obstruct the investigation. Therefore, the decision states that "the court takes into account the personality of the citizens under investigation," assuming that even after they were made aware of the investigation, they continued with the violations.

Not in vain, the prosecutors asked to take into account "the environment where the citizens under investigation live, the public function exercised by citizen Erion Veliaj, the numerous acquaintances, the connections secured and the very strong influence that stems from the exercise of this function, the importance of which increases exponentially given the territory it covers and the public funds administered by the Municipality of Tirana, as the largest Municipality in the country...".
Therefore, to those who truly "lali" resembled the victims of the system, which were masterfully created by Franc Kafka, the answer is "No, this is not true". Because unlike Jozef K, Erjon Veliaj has been at the top of the system, he has had in his hands every instrument of political power to obstruct justice and has not hesitated to use his power.
