Gazment Bardhi has stated that the Constitutional Court has not yet made a decision on the transition to a judicial session of the request of the opposition deputies regarding the agreement between Albania and Italy, for refugees.

Bardhi underlined that Rama ordered the Assembly to bring the approval procedure by the Parliament closer to one week, in order to pass this agreement as soon as possible.

"In an unprecedented act, with silence and in flagrant violation of the Constitution, the Constitutional Court has not yet made the decision to proceed to a court hearing of the request of the opposition deputies regarding the Agreement with Italy for immigrants, an act that is accompanied by the suspension of the parliamentary procedure of its ratification by the Assembly. The preliminary review of the request is a formal process, which does not require a substantive review nor time for in-depth analysis. Taking advantage of the inaction of the Constitutional Court in time, under the serious suspicion of a coordination between them, Edi Rama ordered the Assembly to bring the approval procedure by the Parliament closer by one week, including it in the Agenda of tomorrow's session, December 14, 2023", said Bardhi in a statement to the media.

Bardhi called on the members of the Constitutional Court to adhere to the oath to submit only to the Constitution and not to the interests or political orders of Edi Rama.

"Even though it was officially announced to speed up the procedures in the Assembly, the inaction of the Constitutional Court in time for an urgent matter practically eliminates the possibility of constitutional control over the content of the agreement, which must be reviewed before ratification. This is the most ugly act of the flagrant violation of the Constitution by the Constitutional Court itself, as another proof of its complete control by Edi Rama. The elimination of the possibility of constitutional control, as a constitutional right of the opposition deputies, is an attempt on the rule of law and destroys public trust to the impartiality and independence of the Constitutional Court. Expressing disagreement with the inaction of the Constitutional Court in time and the flagrant violation of the Constitution by it, the Parliamentary Group of the Democratic Party appeals to the members of the Constitutional Court to adhere to the oath to submit only to the Constitution and not to interests or the political orders of Edi Rama. They should immediately give up blocking the timely preliminary examination of the opposition MPs' request, by ordering the suspension of the parliamentary procedure before tomorrow's ratification. The implementation of the Constitution should be the only guide for the activity of the members of the Constitutional Court, and not the hostage-taking with a draft law or the corrupt promise of Edi Rama for unbridled increases in their salaries, in exchange for the flagrant violation of the Constitution and the role that the Constitutional Court plays in a democratic society", said Bardhi./ CNA
