Detention/Lamallari: Must be addressed as an issue

Minister of Justice Besfort Lamallari has been summoned to the Laws Committee to report on the activities of the Ministry of Justice for 2024.

Lamallari referred to pre-trial detention as one of the issues that needs to be addressed.

According to him, one of the greatest injustices that can happen to someone is to spend more time in detention than the time the court then decides in the final decision.

"The concern about pre-trial detention is not only the problem it brings about for the overcrowding in the penitentiary system but also for the citizens who are in pre-trial detention. I believe that one of the greatest injustices that can happen to someone is to spend more time in pre-trial detention than the time that the court then decides in the final decision. This needs to be addressed. This has to do with the way the provisions are written and their implementation in practice.

Prison should be seen as a last resort when and where the relevant conditions of dangerousness, risk of escape, etc. are present.

It definitely requires familiarization and awareness for all relevant actors, prosecutors, judges, and here the role of our partners, including the OSCE, comes to the rescue, when not long ago I had a meeting with the heads of the OSCE, convinced that we will continue this cooperation in initiatives related to advancing the changes taking place in the Criminal Code", said Lamallari./ CNA
