Former Prime Minister Sali Berisha has been under "house arrest" since December 30 of last year, and on June 20 it will be 6 months since he has been absent from the plenary sessions, which could endanger him and lose his mandate as a member of parliament.
The Secretary for Legal Affairs in DP, Ivi Kaso, in an interview for CNA TV, has explained the case where he emphasizes that Berisha does not risk anything in terms of the mandate despite the majority's desire.
"Referring to the constitutional provisions, the legal provisions, the regulation of the parliament, which regulate the status and function of the deputy and previous parliamentary practices, Mr. Berisha does not risk anything in terms of the mandate, which is clearly a desire of the majority, of its exponents, of who have often evoked it in the media and raised this smokestack. The constitution is clear regarding the cases when deputies lose their mandate. One of the cases, in addition to that of voluntarily relinquishing the mandate or when conditions of ineligibility are verified for those related to final decisions that make it impossible to continue the mandate of the deputy, is the case when the deputy without reason decides and chooses not to exercise for a period of more than 6 months. This is clearly not the case of Mr. Berisha, quite the opposite is true", said Kaso.
He further clarified that there is still no criminal charge against Berisha and he has chosen to exercise his mandate as a deputy, even though his physical presence has been denied by SPAK.
"Despite the politically motivated measure of security that was taken against him, despite the fact that he only has the status of a person under investigation, Berisha still does not face a criminal charge today. Berisha has chosen to exercise his mandate. In order to be physically present at the sessions, he has requested more than once from the proceeding body, from the SPAK, to participate in the work of the assembly, this permission was refused for reasons of security needs. This does not mean that Mr. Berisha has ignored the mandate given to him by the voters, but his physical presence in the works of the assembly, in plenary sessions or in the works of the commissions has been made impossible due to the security measure. The constitutional provision, which foresees, not without purpose, the fact of an absence of more than six months, but unjustified, cannot be applied in any case to Mr. Berisha", he said.
Kaso underlined that Berisha has chosen to exercise his mandate in other forms as well, through legislative initiatives, many of which were presented by the Parliamentary Group of the DP in the Assembly.
