The Special Court of Kosovo has published the request of the Specialized Prosecutor's Office addressed to the court, with which it requested that Hashim Thaçin, Rexhep Selim and Kadri Veselin be temporarily isolated and suspend all their non-privileged external communications. including visits (either in person or via Zoom), phone calls, written communications, and sending other items.

According to the request of the ZPZ addressed to the court on November 17, Hashim Thaçi, Kadri Veseli and Rexhep Selimi violated the orders of the court by revealing the identity of the protected witnesses or by distributing the contents of the confidential testimonies to the persons who visit them at the Center of Detention.

Below is a part of the prosecution's request:

1. Hashim THAHAI, Kadri VESELI and Rexhep SELIMI ("The three accused") have violated the orders of the Trial Panel by revealing the identity of the protected witnesses and/or by distributing the contents of the confidential testimonies to the persons who visit them in the Detention Center. Investigations by the Office of the Specialized Prosecutor (SPO) have also uncovered further attempts to obstruct proceedings, including issuing instructions on how witnesses should testify and planning approaches to witnesses.

2. Consequently, and in accordance with Articles 21 and 41 of the Law, Rules 23(7) and 56(6) of the Rules, and Rule 43(3)(c) of the Detention Rules, the SPS urgently requests from the Trial Panel (' Body') of: a. on an interim basis, immediately sequester the three accused and suspend all of their non-privileged external communications – including visits (whether in person or via Zoom), phone calls, written communications and import-export – until the Panel has had an opportunity to decide on the merits of this request;

b. to limit non-privileged communications of the three accused to a designated group of immediate family and consular officials to be proposed by the three accused and pre-approved by the Panel following submissions by the SPS;

c. order the active monitoring (by an Albanian speaker) of all non-privileged communications in any form, including in particular:

i. active monitoring and audio and video recording of all non-privileged zoom calls, and retention of such records until the conclusion of the trial;

ii. active monitoring and audio recording of all telephone calls and preservation of such data until the conclusion of the trial;

iii. the careful examination and copying of all import-export correspondence and articles and the preservation of such records until the conclusion of the trial;

d. të urdhërojë që të mos lejohen vizita jo të privilegjuara personalisht dhe që kontakte të tilla të kryhen vetëm nëpërmjet Zoom ose telefonit dhe në varësi të monitorimit të përshkruar më sipër;

e. të urdhërojë që vizitat e privilegjuara të kufizohen vetëm për avokatët dhe bashkë-avokatuesit, me përjashtim të rasteve të autorizuara më parë nga Paneli në përputhje me paragrafët 47-49 më poshtë;

f. të urdhërojë që të mos ketë vizitorë të përbashkët ndërmjet tre të akuzuarve dhe të paraburgosurve të tjerë, siç përshkruhet në paragrafin 46 më poshtë;

g. të urdhërojë që përmbajtja e të gjitha komunikimeve jo të privilegjuara me/nga Tre të Akuzuarit të kufizohet në çështje që nuk kanë lidhje me provat dhe dëshmitarët në këtë rast (pavarësisht nga klasifikimi i një informacioni të tillë si publik ose konfidencial);

h. të urdhërojë ndarjen e tre të akuzuarve nga të gjithë të paraburgosurit e tjerë aktualë në Qendrën e Paraburgimit; dhe

i. të urdhërojë Sekretarinë t’i raportojë Panelit dhe Palëve, në mënyrën e përshkruar në paragrafin 50 më poshtë.

3. Masat e kërkuara janë të nevojshme për të adresuar rrezikun konkret të (a) përpjekjeve të paligjshme për të ndërhyrë te dëshmitarët dhe për të penguar dëshminë e tyre; (b) shpërndarjen nga Qendra e Paraburgimit të informacionit të dëshmitarit të mbrojtur, duke përfshirë dëshminë konfidenciale të dhënë në këtë rast; dhe (c) kërcënime të mëtejshme ndaj integritetit të procedurës. Masat e kërkuara janë mjetet më pak kufizuese për të arritur objektivat e nevojshme.

4. Së fundi, si organi përgjegjës për menaxhimin e objekteve të paraburgimit dhe mirëqenien e të paraburgosurve, si dhe organi më i vendosur për të zbatuar masat e nevojshme, ZPS-ja sugjeron që Trupit Gjykues të ftojë parashtresat nga Sekretaria për parashtresat ZPS -së.

II. NUMËRIMI I FJALËVE

5. Si çështje paraprake, dhe në përputhje me nenin 36 të Udhëzimit të Praktikës mbi Skedarët dhe Dosjet, ZPS kërkon një zgjatje të kufizuar të numrit të fjalëve në 8150 fjalë për qëllimet e kësaj dosjeje. Domosdoshmëria e kësaj zgjatjeje të kufizuar u bë e dukshme vetëm në fazat përfundimtare të përgatitjes së dosjes, dhe arsyeja e mirë lind në këtë rast duke pasur parasysh nevojën për të siguruar bazën e plotë faktike dhe ligjore, duke përfshirë dhënien e shembujve të bazës së provave.

III. DORËZIMET

6. Shumë dëshmitarë të mbrojtur në këtë rast kanë raportuar se janë afruar nga persona që tentojnë të pengojnë ose ndikojnë në dëshminë e tyre. Siç përshkruhet më poshtë, në një numër rastesh, këto qasje u treguan se ishin drejtuar nga një ose më shumë nga tre të akuzuarit dhe/ose personat që i kishin vizituar ata në Hagë. Në bazë të autorizimit gjyqësor nga gjyqtari i vetëm, ZPS ka regjistruar në mënyrë të fshehtë vizita të paprivilegjuara me audio tek tre të akuzuarit në Qendrën e Paraburgimit (‘Incizime’).

7. From the limited selection of recorded visits, and despite some hindrances to review, ZPS's analysis to date indicates that in many cases, the Three Defendants used their non-privileged visits to illegally disseminate information of protected witnesses, to identify the witnesses, and in the THA?I case, repeatedly instructed the visitors to seek to manipulate the witnesses' testimony.
