"The burden of proof cannot be placed on the defense"/ Selim's

Rexhep Selim's lawyer delivered his speech on the day of the trial in The Hague.

In his opening statement, attorney Geoffrey Roberts stated that the prosecution's inability to distinguish between evidence and allegations is both disturbing and surprising. Roberts said that his client did not use the alleged phrase "special warfare."

Addressing the jury, Selim's lawyer asked them to review every document the prosecution used to conclude whether the weak claims presented are credible.

Further, attorney Roberts stated that the SPO seeks to equalize the defense with the prosecution, but this cannot be done as there is a large difference in the burden of proof.

 

" The prosecution's inability to distinguish between allegations and evidence is both disturbing and surprising. The prosecution's lack of clarity and confidence in its arguments."

Regarding the irrelevance of the phrase "special war", this phrase was not used by Mr. Selimi.

Please review every document the prosecution has used in order to conclude whether their weak claims are credible.

The prosecution claimed that Zyrap said that the inspector general had the authority to exercise unlimited control. As for the handwritten notes, the prosecution referred to the defense's submission to treat it as expertise. Apparently, the prosecution forgot something, it is its burden to prove it. The burden of proof cannot be placed on the defense. 

"The prosecution is trying to put us on the same side as them. There is a big difference in the burden of proof.  Regarding Selim's contribution, the response from the prosecution was that they would not withdraw the charges against Qirezi in relation to Mr. Selimi.  The prosecution has changed its narrative, regarding Selim's alleged contributions to the NPK, it is disturbingly silent ," Roberts said./CNA
